After Vietnam discards household registration books, how will related administrative procedures change?

It is known that the household registration book is valid until the end of December 31, 2022. However, in many administrative procedures, a household registration book is required for verification. So by the beginning of 2023, how will these procedures change? “Long Khanh-Dak Lak”

LawNet would like to give answer as following:

1. When to revoke the household registration book:

According to the Residence Law 2020 of Vietnam, there are important milestones for the issuance and use of household registration book that people should note are as follows:

- From July 1st, 2021: Revocation of household registration book in case of information change; Do not issue new household registration book; The issued household registration book and Temporary Residence Register are still used; In case where information in a household registration book or temporary residence register differs from information in the residence database, the latter shall be used.

- From January 1st, 2023: All household registration books are no longer valid.

Therefore, issued household registration books may continue to be used and are equivalent to written confirmations of residence per this Law until December 31st, 2022 inclusive. From January 1st, 2023, all household registration books are no longer valid.

2.When there are revocation of household registration book, how are related administrative procedures conducted?

Revocation of household registration book means that all information of citizens in the revoked household registration book has been fully updated on the National Population Database.

The purpose of requesting the household registration book is to confirm the personal information of the individual. Therefore, when carrying out related procedures requiring previous household registration book such as enrollment registration, vehicle registration, housing records, etc., citizens' information will be exploited on the Residential Database to confirm without having to present the household registration book.

Pursuant to Clause 3 Article 22 of the Residence Law 2020 of Vietnam, within 07 working days starting from the date of receipt of an adequate and valid application, the registration authority shall appraise and update information on the new permanent residence of the applicant to the residence database and notify the applicant of such update; and provide a written explanation for the applicant if the application rejected.

In addition, pursuant to Article 37 of the Residence Law 2020 of Vietnam, the National  Database will update information including family name, middle name and first name given upon birth, date of birth, permanent residence, temporary residence, and current residence.

Therefore, when there is revocation of household registration book, citizens just need to show their chip-based ID cards, competent authorities will be able to look up information on residence and identity.

On the other hand, for carrying revision of residence information on change of household head, change to information on their civil status in residence database, citizens need to follow provisions prescribed in Article 26 of the Residence Law 2020 of Vietnam:

Application for revision of residence information includes:

- Declaration of change to residence information;

- Written proof of the change.

Procedure for revision of residence information:

A household member shall submit an application to the registration authority.

Within 03 working days starting from the date of receipt of an adequate and valid application, the registration authority shall revise information on the household head in the residence database and notify the applicant of such revision; and provide a written explanation for the applicant if the application rejected.
