Hello, Lawnet would like to answer as follows:

1. What are the requirements to register for recruitment or take the civil servant recruitment exam in Vietnam?

According to subsection 1, Section II, Appendix issued together with Decision 1098/QD-BNV, the conditions to carry out civil servant recruitment examination procedures are as follows:

(1) Conditions for registration are as prescribed in Article 22 of the Law on Public Employees 2010. Agencies and units with authority to recruit public employees specified in Clause 1, Article 24 of the Law on Public Employees 2010 are supplemented with other conditions according to the requirements of the job position specified at Point g, Clause 1, Article 22 of the Law on Public Employees 2010 but not lower than the general standards, not contrary to the provisions of law, and not discriminating between types of training.

- People who meet the following conditions, regardless of ethnicity, gender, social class, belief, or religion, can register for civil servant recruitment:

+ Have Vietnamese nationality and reside in Vietnam;

+ From 18 years old or older. For some fields of cultural, artistic, physical training, and sports activities, the application age may be lower than prescribed by law; At the same time, there must be written consent from the legal representative;

+ Have an application for admission;

+ Have a clear background;

+ Have a diploma, training certificate, practice certificate, or have aptitude and skills appropriate to the job position;

+ Meet the requirement on health to perform work or tasks;

+ Meet other conditions as required by the job position as determined by the public service unit but must not violate the provisions of law.

- The following people are not allowed to register for civil servant recruitment:

+ Loss of civil act capacity or limited civil act capacity;

+ Being prosecuted for criminal liability; serving criminal sentences or decisions of the Court; being subject to administrative measures and being sent to a medical treatment facility, educational facility, or reformatory.

(2) Priority conditions in public employee recruitment (Article 6 of Decree 115/2020/ND-CP supplemented by Clause 2, Article 1 of Decree 85/2023/ND-CP)

- Heroes of the Armed Forces, Labor Heroes, war invalids, policy beneficiaries such as war invalids, class B war invalids: 7.5 points are added to the round 2 score results;

- Ethnic minorities, military officers, police officers, serving professional soldiers, people doing cipher work changing branches, students who graduate from reserve officer training, graduate from training for commanders of commune-level military commands of the grass-roots military sector are awarded the rank of reserve officers, have registered for the rank of reserve officers, and are children of martyrs, children of war invalids, children of sick soldiers, children of policy beneficiaries such as war invalids, children of category B war invalids, offspring of resistance activists infected with toxic chemicals, children of Heroes of the Armed Forces,  children of Labor Hero: 5 points added to round 2 score results;

- People who complete military service, people's public security service, and youth volunteer team members: 2.5 points are added to the round 2 score results.

- Trade union officials who grew up from the grassroots, in the labor movement: 1.5 points are added to the results of round 2.

3. Instructions for filling out the definite-term working contract form

Decision 1098/QD-BNV guides how to write a fixed-term working contract form as follows:

- Specify the name of the business unit.

- If the contract has a term, clearly state the start and end dates.

- Specify the number of houses, streets, wards (village, commune), districts (district, town), provinces, provincial, or central cities.

- Specify the tasks to be performed.

- Specify the number of working hours per day, per week, or working according to office hours.

- Transportation to work is provided by the unit, or the employee takes care of it himself.

- Specify the appointed professional title, main salary, and form of payment (time salary, contract, etc.).

- Specify the percentage of allowances (if any) such as: area, price escalation, toxicity, attraction, seniority, responsibility, etc.

- Specify the social insurance benefits and other benefits that the employee is entitled to. For example: receive social insurance benefits according to the State's current regime.

- Specify other commitments associated with the nature and characteristics of the industry, field, and specific conditions of public service units, but not contrary to the provisions of the Law on Public Employees 2010 and other relevant legal provisions.

- Specify which benefits the employee is entitled to, as stated in this section.

- Other agreements are often incentive agreements and are more beneficial to officials such as: Cheap items that perish quickly, when damaged or lost, do not have to be compensated. If the working contract is well performed, they can travel, vacation, or visit for free, and receive 13th and 14th month salaries; get a few extra days to a week off; get an extra allowance for accidents outside working hours, and get birthday gifts.
