The Government to approve 05 Law Projects in Vietnam according to Resolution 115/NQ-CP

Have the draft laws been approved at the latest meeting of the Government in Vietnam? “Van Anh-Binh Dinh”

Hello, Lawnet would like to answer as follows:

The Government issued Resolution 115/NQ-CP dated July 28, 2023 at a thematic meeting on lawmaking in July 2023.

The Government to approve 05 Law Projects in Vietnam

At the Meeting, the Government of Vietnam focused on discussing 08 important and complex contents with a wide scope of adjustment and great impacts on socio-economic development, businesses, and people's lives, including:

(1) Project Law amending and supplementing a number of articles of the Law on Asset Auction

The Government agrees on the need to develop a Law project to concretize the Party's guidelines and State policies on promoting administrative reform, judicial reform, preventing and combating corruption, and negativity in handling public assets.

  Ensuring uniformity and uniformity of the legal system; overcoming limitations and inadequacies in the practical implementation of the 2016 Asset Auction Law.

  The Government basically agrees on the amendments and supplements to the draft Law. The Ministry of Justice presides and coordinates with the Government Office and relevant ministries and agencies to continue researching and absorbing comments from Government Members as much as possible.

(2) Social Insurance Law Project (amended)

(3) Proposal to develop a Law on the prevention and combat of human trafficking (amended)

The Government basically agrees with 03 policy contents, including:

- Complete regulations on grounds for identifying victims.

- Regulate support regimes for people who are in the process of being identified as victims.

- Complete regulations to improve regimes and policies to support and protect victims.

  The Ministry of Public Security presides and coordinates with the Ministry of Justice, the Government Office and relevant agencies to receive the maximum number of opinions from Government Members.

 (4) Proposal to develop a Law on Excise Tax (amended)

The Government is basically unified with 07 policy groups, including:

- Complete regulations on subjects subject to a excise tax.

- Complete regulations on subjects not subject to a excise tax.

- Complete regulations on excise tax bases.

- Complete regulations on excise tax prices.

- Complete regulations on excise tax rates.

- Complete regulations on excise tax refund.

- Complete regulations on implementation provisions.

The Ministry of Finance presides over and coordinates with the Ministry of Justice, the Government Office and relevant ministries and agencies to research and absorb the maximum opinions of Government Members.

(5) Proposal to develop a Law on Value Added Tax (amended)

The Government basically agrees with 05 policy groups, including:

- Complete regulations on subjects not subject to value-added tax.

- Complete regulations on value-added tax prices

- Complete regulations on value-added tax rates

- Complete regulations on input value-added tax deduction.

- Complete regulations on value-added tax refund

The Ministry of Finance presides over and coordinates with the Ministry of Justice, the Government Office and relevant ministries and agencies to research and absorb maximum opinions of Government Members.

(6) Draft Resolution of the National Assembly on piloting a number of mechanisms and policies to remove obstacles prescribed in a number of Laws related to investment in the construction of road traffic works

The Government basically agrees with the content, draft Proposal, Report and draft Resolution submitted to the National Assembly Standing Committee and the National Assembly as proposed by the Ministry of Planning and Investment in Report No. 5894/BC-BKHDT, which is Report No. 5895/TTr-BKHDT dated July 26, 2023.

Ministries, agencies, and localities research and give opinions on the principles, selection criteria, and list of pilot projects according to the proposal of the Ministry of Planning and Investment in the above documents, sent to the Ministry of Planning and Investment on July 28, 2023.

(7) The report proposes the application of a global minimum tax

The Government requests Ministers, Heads of ministerial-level agencies, and agencies under the Government to urgently research and provide direct comments on the Proposal and draft Resolution of the National Assembly on the application of global minimum tax and mechanisms and policies to support non-tax investors, sent to the Ministry of Finance and Ministry of Planning and Investment on July 28, 2023.

(8) Report on proposals for mechanisms and policies to support non-tax investors

Assign the Minister of Justice, authorized by the Prime Minister, to sign the Government's Proposal on behalf of the Government before August 5, 2023 to report to the National Assembly. The National Assembly Standing Committee supplements the draft Resolution of the National Assembly.

Regarding the application of additional corporate income tax according to regulations to prevent global tax base erosion and the draft Resolution of the National Assembly on pilot application of investment support policies in the field of high technology into the Program for developing Laws and Ordinances in 2023 and allowing the development of draft Resolutions if following the shortened order and procedures, submitted to the National Assembly for approval according to the process of one National Assembly session. (at the meeting on October 6, 2023).

Resolution 115/NQ-CP 2023 was issued on July 28, 2023.
