The Government of Vietnam issued Resolution 115/NQ-CP on July 28, 2023, regarding the special meeting on legislative development in July 2023.
At the meeting, the Government of Vietnam focused on discussing 08 important, complex issues with wide-ranging impacts on economic and social development, businesses, and people's lives, including:
The Government of Vietnam agreed on the necessity of developing this law project to concretize the Party's guidelines and the State's policies on accelerating administrative reforms, judicial reforms, and anti-corruption measures, especially concerning the handling of public assets.
Ensure the consistency and uniformity of the legal system; address limitations and inadequacies in the implementation of the Asset Auction Law 2016.
The Government of Vietnam fundamentally agreed with the amendments and supplements in the draft law. The Ministry of Justice will lead, in cooperation with the Government Office, and relevant ministries and agencies, to continue researching and incorporating the maximum feedback from Government members.
The Government of Vietnam basically agreed with 03 main policy points, including:
- Completing the regulations on the criteria for identifying victims.
- Stipulating policies to support individuals in the process of being identified as victims.
- Enhancing the policies for supporting and protecting victims.
The Ministry of Public Security will lead, in cooperation with the Ministry of Justice, the Government Office, and relevant agencies, to incorporate the maximum feedback from Government members.
The Government of Vietnam basically agreed with 07 policy groups, including:
- Completing the regulations on the entities subject to special consumption tax.
- Completing the regulations on the entities not subject to special consumption tax.
- Completing the regulations on the basis for calculating special consumption tax.
- Completing the regulations on the price for calculating special consumption tax.
- Completing the regulations on special consumption tax rates.
- Completing the regulations on special consumption tax refunds.
- Completing the regulations on the implementation clauses.
The Ministry of Finance will lead, in cooperation with the Ministry of Justice, the Government Office, and relevant ministries and agencies, to incorporate the maximum feedback from Government members.
The Government of Vietnam basically agreed with 05 policy groups, including:
- Completing the regulations on the entities not subject to value-added tax.
- Completing the regulations on the basis for calculating value-added tax.
- Completing the regulations on value-added tax rates.
- Completing the regulations on input value-added tax deductions.
- Completing the regulations on value-added tax refunds.
The Ministry of Finance will lead, in cooperation with the Ministry of Justice, the Government Office, and relevant ministries and agencies, to incorporate the maximum feedback from Government members.
The Government of Vietnam basically agreed with the content, the draft submission, the report, and the draft resolution submitted to the National Assembly Standing Committee and the National Assembly as proposed by the Ministry of Planning and Investment in Report No. 5894/BC-BKHDT and Submission No. 5895/TTr-BKHDT dated July 26, 2023.
Ministries, agencies, and localities are to research and provide input on the principles, criteria for selection, and the list of pilot projects as proposed by the Ministry of Planning and Investment in the aforementioned documents, and send them to the Ministry of Planning and Investment by July 28, 2023.
The Government of Vietnam requires ministers, heads of ministries, and agencies under the Government of Vietnam to urgently research and provide direct feedback on the submission and the draft resolution of the National Assembly regarding the implementation of global minimum tax and the mechanisms and policies to support investors outside the tax system, and send them to the Ministry of Finance and the Ministry of Planning and Investment by July 28, 2023.
The Minister of Justice is authorized by the Prime Minister of the Government of Vietnam to, on behalf of the Government of Vietnam, sign the submission of the Government of Vietnam by August 5, 2023, to report to the National Assembly, the National Assembly Standing Committee on supplementing the draft resolution of the National Assembly.
Regarding the implementation of a supplementary corporate income tax under the global base erosion rules and the draft resolution of the National Assembly on the experimental implementation of investment support policies in the high-tech field into the legislative program for 2023 and to allow the development of draft resolutions following an abbreviated procedure, to be approved by the National Assembly through a one-session process (at the 6th meeting session in October 2023).
