Summary of judgments on crimes of violating regulations on protection of endangered, precious and rare animals in Vietnam

Currently, the status of illegal hunting, killing, raising, confining, storing, transporting and trading wild animals, animals on the red list of Vietnamese animals such as bears, gibbons, otters, lions, king cobras... still occur in many places and cause much frustration among people, seriously affecting the ecological environment, increasing pressure on the protection of nature.

All acts of illegally hunting, killing, raising, confining, possessing, transporting and trading wild animals need to be detected, prevented in time and depending on the nature and seriousness of the violation, they will be sanctioned for serious administrative violations or examined for penal liability.

Below is a summary of judgments on violations of regulations on protection of endangered, precious and rare animals, please refer to:

1. Judgment 25/2022/HS-PT for violating regulations on the protection of endangered, precious and rare animals 

- Judgment level: Appellate

- Judicial body: People's Court of Dak Nong province

- Quote content: “In June 2019, Nguyen Manh T bought 02 gibbons, weighing about 0.5kg/head from two ethnic minority grandchildren (whose identity is unknown) in C commune, E district for 300,000 VND and then brought them home which is Hamlet 6B, Commune C to keep them in captivity. On the morning of May 1, 2021, Nguyen Manh T and Hoang Anh T made an iron cage, then locked 02 gibbons in the cage, and placed them in an empty lot behind the administrative complex of the hi-tech agricultural zone. After that, Nguyen Manh T returned to his home in district E, and Hoang Anh T continued to raise these two gibbons, until June 25, 2021, the Forest Protection Department of G city discovered and seized and temporarily seized the objects and documents including 02 living animals; 01 video file recording the incident of 02 living animals being kept in captivity (filmed by the G City Forest Protection Department, currently stored and sealed in a USB device, capacity 08G).”

2. Judgment 38/2021/HS-ST for violation of regulations on the protection of endangered, precious and rare animals

- Quote from the content: "At 17:20 on January 21, 2021, the P district police task force discovered that Vu Ngoc Q was driving a motorbike carrying a box of paper without labels moving into the yard of Lanchimart supermarket, so he conduct administrative checks. Through inspection, it was discovered that inside the carton, there was a cylindrical glass jar, about 45cm high, 20cm bottom, a spherical flask with a diameter of about 5cm, inside containing a dead king cobra being soaked in alcohol. Q claimed to be shipping to sell to customers. The police office of district P has made a record to arrest the offender in the act."

3. Judgment 33/2021/HS-ST for violation of regulations on the protection of endangered, precious and rare animals

- Judicial body: People's Court of Ngoc Hoi district, Kon Tum province

- Quote from the content: "Around June 2020, D ordered through social networks and bought from an unknown person 15 black bear claws for 3,000,000 VND and 05 white lion claws for 2,000,000 VND, D brought them home and hid them in the refrigerator at D's house at 91st street T, residential group 6, town P, district N. Around September 2020, an unknown person came to D's house to ask to buy bear paws. D sold this person 03 black bear claws, priced at VND 1,500,000. The remaining claws included 12 bear paws and 5 lion paws. D was hidden in the refrigerator of D's house. At about 9.25 pm on November 23, 2020, checked by the N district police. D has sincerely confessed and voluntarily surrendered all of the above animal nails.”

4. Judgment 184/2021/HS-ST for violation of regulations on the protection of endangered, precious and rare animals

- Judicial body: People's Court of Long Bien District, Hanoi

- Quoting the content: "At 10.30 am on September 22, 2020, the working group of Ngoc Thuy Ward Police coordinated with the Economic Police Team of the Long Bien District Police to discover Nguyen Van D standing next to a motorbike carrying a motorbike. Behind 01 styrofoam box with suspicious signs should be checked. Through inspection, the police agency discovered inside the foam box, there was 01 living animal suspected of otters, 01 living animal suspected of being civets, and 02 dead animals suspected of being civets. At the time of inspection, D could not produce documents to prove the origin of the above animals, so the working group made a record of confiscation of exhibits and brought people and exhibits to the headquarters for settlement."

5. Judgment 06/2022/HS-ST for violation of regulations on protection of endangered, precious and rare animals

- Judicial body: People's Court of Phu Luong district, Thai Nguyen province

- Quoting the content : "About 16:30 on November 3, 2021, at the house of Mr. Nguyen Van T1- 1968, The forest ranger of Phu Luong district discovered and caught Nguyen Van N, the son of Mr. T1, who had locked up 01 individual snake suspected of being a king cobra. The working group made a record, sealed the exhibits and handed over the documents and exhibits to the Police Department - Phu Luong District Police for settlement according to their competence. The Police Department - Phu Luong District Police has issued a decision to solicit the assessment of 01 seized snake.
