Summary of divorce judgments – Division of common property due to conflicts with mother-in-law in Vietnam

There are many reasons leading to divorce between couples and the most common reason is an unhappy coexistence due to disagreements, incompatibility, and unhappiness in life.

Another reason why many couples divorce is the conflict between mother-in-law and daughter-in-law. In addition, disputes over the property during cohabitation between parents-in-law, husband and daughter-in-law are also quite complicated because it is difficult to determine the bride's contribution to the common property.

1. Judgment 02/2021/HNGĐ-ST dated January 6, 2021 on a divorce application (dividing efforts and contributions when living with parents-in-law)

- Quote from the content: "Mr. Q and Ms. S came together and registered their marriage on February 29, 2004 at the People's Committee of commune P, Phu Yen district, Son La province on a voluntary basis, not forced by someone. Through the process of living together in harmony and happiness for about 16 years, husband and wife conflicts arise due to disagreements about economic and daily life and conflicts between mother-in-law and daughter-in-law. The relationship between husband and wife is no longer, the conflict is too serious, the life together cannot be prolonged, the purpose of marriage cannot be achieved, so Mr. K decided to ask for a divorce from Ms. Cam Thi S."

2. Judgment 60/2018/HNGĐ-ST  dated November 8, 2018 on marriage and family disputes

- Quote from the content: “He married Ms. Nguyen Thi M in 2005 before getting married, both sides could find out a voluntary agreement. He and Ms. M lived in harmony until 2014, when a conflict arose, the reason being that Ms. M had incorrect words with his mother. Once, Ms. M hit her mother on the head with a glass bottle and had to go to the hospital. In addition, brother and sister M often quarreled with each other. Because they could not stand such a situation, the couple lived separately and cut off all romantic relationships, no one cares about anyone since May 2015 until now. Now, Mr. K considers that the husband and wife's relationship can no longer be reunited, and she requests a divorce from Ms. M."

3. Judgment 06/2020/HNGĐ-PT dated 30/11/2020 on divorce, property division upon divorce

- Quoting the content: "Mr. Vo Hung N and Ms. Bach Thi Kim T got married on December 20, 2019, on a voluntary basis. After getting married, the husband and wife lived together at Mr. N's parents' house. After being happy for about 1 month, a conflict arose. According to Mr. N, the reason is that Ms. T does not accept the suggestions of him and his parents, or argues when he and his parents only tell him about household chores. On May 8, 2020, Ms. T ran away from home without saying anything to him and his father and mother, then texted him to insult him, so he angrily blocked T's phone from answering her phone. He saw that the couple's affection was no longer there, and the conflict could not be healed, so he asked for a divorce from Ms. T."

4. Judgment 39/2020/HNGĐ-ST dated August 25, 2020 on marriage and family disputes

- Quoting the content: "Ms. Nguyen Thi H married Mr. Khuat Thanh G on April 7, 2017 before getting married, having researched and registered at the People's Committee of Vinh Ninh commune. After getting married, she went back to being a bride and lived with Mr. G's family. At first, the relationship between husband and wife was normal. The husband and wife lived together for about 07 to 8 months, when there was a conflict between her and Mrs. T (G's mother), his mother often noticed bad things about her and Mr. G could not resolve the conflict between the two of them. mother-in-law and daughter-in-law. After that, due to economic disagreement, Mr. G went to work to give money to his mother, not to worry about the family that did not match and could not find a common voice. She determined that the husband and wife's relationship no longer existed, so she asked for a divorce from Mr. G."

- Quote from the content: "She married Mr. Bui Manh C on March 14, 2016 voluntarily, with marriage registration at the People's Committee of commune A, district P, Phu Tho province. During the process of living together in harmony and happiness for about 3 months, a conflict arose, the cause of the conflict was the husband and wife's disagreement on life views, incompatible lifestyles, and conflicts between Mr. C's mother and her sister. Mr. C has repeatedly cursed, and threatened both physically and mentally. Once, Mr. C beat her in front of his mother-in-law and the maid. Now, the relationship between husband and wife is no longer, so she filed a lawsuit to ask the Court to grant her a divorce from Mr. Bui Manh C."
