Resolution 144/NQ-CP in Vietnam: Payment of health insurance medical examination and treatment costs for 2021 based on the annual settlement report

I read in the newspaper that the Government of Vietnam has just issued a Resolution directing the payment of medical examination and treatment costs under health insurance. Please provide me with detailed information about this. (Minh Long - Quang Ninh)

Hello, Lawnet would like to respond to your inquiry as follows:

On November 05, 2022, the Government of Vietnam issued Resolution 144/NQ-CP ensuring medicine, medical equipment, and payment of medical examination and treatment costs under health insurance (HI).

The Government of Vietnam directed as follows:

Regarding the payment of HI medical examination and treatment costs in Vietnam

Settlement and payment of HI medical examination and treatment costs for 2021 shall be based on the annual settlement report of the medical examination and treatment facility after being verified by the Social Insurance agency, in accordance with Clause 2, Article 32 of the 2014 Amended Health Insurance Law, including:

- Fees for examinations, beds, and technical services, tests, blood, and blood products used for patients within the scope of benefits and entitlement levels of HI participants:

The settlement and payment shall be carried out according to the actual quantity used and unit prices as per current regulations.

- Costs of drugs, chemicals, and medical supplies that have not been included in the HI medical examination and treatment service prices or used in techniques without HI medical examination and treatment service prices, used for patients within the scope of benefits and entitlement levels of HI participants:

The settlement and payment shall be carried out according to the actual quantity used and the purchase price according to the provisions of bidding law.

Additionally, it is allowed to continue paying HI medical examination and treatment costs for technical services performed by machines provided by contractors after winning the bid for materials and chemicals according to the contractor selection results approved by competent authorities before November 05, 2022.

The implementation period shall follow the contract duration signed before November 05, 2022, or not exceed 12 months from November 05, 2022.

The Government of Vietnam directs the Ministry of Health to draft the Law amending the Pharmaceutical Law

- Preside over, cooperate with the Ministry of Justice of Vietnam, and related agencies to prepare the proposal to draft the Law amending and supplementing certain provisions of the Pharmaceutical Law according to the procedures stipulated in the Law on Promulgation of Legal Documents, focusing on simplifying administrative procedures related to the issuance, renewal, modification, and supplementation of the Marketing Authorization for drugs as approved by the Prime Minister of the Government of Vietnam in Decision 1661/QD-TTg dated October 04, 2021;

- Preside over, cooperate with relevant ministries and central authorities to draft and submit to the Government of Vietnam amendments, and supplements to Decree 146/2018/ND-CP detailing and guiding the implementation of certain provisions of the Health Insurance Law, Decree 54/2017/ND-CP detailing certain provisions and implementing measures of the Pharmaceutical Law, Decree 155/2018/ND-CP amending and supplementing certain regulations related to investment and business conditions under the state management scope of the Ministry of Health, Decree 98/2021/ND-CP on management of medical equipment;

- Amend and supplement Circular 19/2021/TT-BYT regulating the form of documents, and reports implementing Decree 98/2021/ND-CP on management of medical equipment; Circular 14/2020/TT-BYT dated July 10, 2020 regulating certain contents in bidding for medical equipment at public health facilities, and Circular 15/2019/TT-BYT dated July 11, 2019 regulating the bidding for drugs at public health facilities;

- Preside over, cooperate with the Ministry of Finance and relevant ministries and central authorities to research and amend, supplement, or issue new documents on procurement and bidding, especially issues related to lease of assets, and provision of equipment after winning bids for chemicals and biological products; regarding management, and use of licensing fees for products and goods in the healthcare field.
