Organizational structure of the Government of Vietnam

What is the organizational structure of the Government of Vietnam? “Vu Ninh-Quang Ninh”

Hello, The Lawnet would like to answer the following:

1. Organizational structure of the Government of Vietnam

According to Clause 2, Article 2 of the Law on Government Organization 2015, the organizational structure and members of the Government of Vietnam are as follows:

- The Government shall be composed of the Prime Minister, Deputy Prime Ministers, Ministers and Heads of Ministry-levels. The structure and number of Government members shall be submitted by the Prime Minister to the National Assembly for decision.

In there:

+ The Prime Minister is the head of the government and the head of the state administrative system. The Prime Minister is elected by the National Assembly from among the National Assembly deputies proposed by the President. 

+ Deputy Prime Minister: take responsibility before the Prime Minister for assigned tasks and tasks. In the government, there will usually be four Deputy Prime Ministers.

+ Ministers and heads of ministerial-level agencies are members of the government, heads of ministries and branches, and managers in different fields; they are responsible for the management, implementation, and supervision of compliance with the law in the assigned sectors and fields throughout the country.

Currently, the government of the Socialist Republic of Vietnam has 22 ministries along with four ministerial-level agencies. Ministries are organized vertically, divided by socio-economic sectors. Each ministry agency is in charge of managing a sector, and the ministry is headed by the minister. The Minister is responsible to the Government, the National Assembly, and the President. As follows:

- Department of Defense

 Ministry of Police

 Ministry of Foreign Office

- Ministry of Home Affairs

- Judicial

- Ministry of Planning and Investment

 Ministry of Finance

- Ministry of Industry and Trade

- Ministry of Agriculture and Rural Development

 Ministry of Transport

- Ministry of Construction

- Ministry of Natural Resources and Environment

- Ministry of Information and Communications

- Ministry of Labor, War Invalids and Social Affairs

- Ministry of Culture, Sports and Tourism

- Ministry of Science and technology

- Ministry of Education and Training

- Ministry of Health

4 ministerial-level agencies include:

- Ethnic Committee

- The bank of Viet Nam

- Government inspector

- Goverment office

In addition, the Government also has 7 other agencies such as: Radio Voice of Vietnam, Vietnam Social Security, Vietnam News Agency, Vietnam Academy of Social Sciences, State Capital Management Committee in Vietnam. businesses, Vietnam Television, Management Board of President Ho Chi Minh Mausoleum,....

2. What are the functions and tasks of the Government of Vietnam?

According to Articles 94 and 96 of the Law on Government Organization 2015, the government has the following functions and tasks:

- The government is the highest state administrative body of the Socialist Republic of Vietnam, exercising executive power through the National Assembly.

- The government is responsible to the National Assembly and reports on its work to the National Assembly, the National Assembly Standing Committee, and the State President.

- The duties and powers of the government are as follows:

+ Organizing the implementation of the Constitution, laws and resolutions of the National Assembly, ordinances and resolutions of the National Assembly Standing Committee, and orders and decisions of the State President;

+ Proposing and formulating policies to submit to the National Assembly and Standing Committee of the National Assembly for decision or decide according to its competence to perform the tasks and exercise the powers specified in this Article; submit law projects, state budget projects, and other projects to the National Assembly; submit the ordinance project to the National Assembly Standing Committee;

+ Unified management of economy, culture, society, education, health, science, technology, environment, information, communication, foreign affairs, defense, national security, and social security; to execute general or local mobilization orders, orders to declare a state of emergency, and other necessary measures to protect the Fatherland and to ensure the people's lives and properties;

+ Submitting to the National Assembly to decide on the establishment or abolition of ministries and ministerial-level agencies; establishment, dissolution, merger, division, and adjustment of administrative boundaries of provinces, centrally run cities, and special administrative-economic units; submitting to the Standing Committee of the National Assembly for decision the establishment, dissolution, merger, division, and adjustment of the boundaries of administrative units under provinces and centrally run cities;

+ Unified management of national administration; carry out management of cadres, civil servants, public employees, and public services in state agencies; organize inspection, examination, settlement of complaints and denunciations, prevention, and combat of bureaucracy and corruption in the state apparatus; lead the work of ministries, ministerial-level agencies, government agencies, and People's Committees at all levels; Guide and inspect the People's Council in implementing documents of superior state agencies; create conditions for the People's Council to carry out its duties and powers prescribed by law;

+ Protecting the rights and interests of the state and society, human rights, and citizens' rights; ensuring social order and safety;

+ Organizing negotiations and signing international treaties in the name of the State under the authorization of the President; deciding on the signing, accession, approval, or invalidation of international treaties in the name of the Government, except for international treaties submitted to the National Assembly for ratification specified in Clause 14, Article 70; protecting the interests of the State and the legitimate interests of Vietnamese organizations and citizens abroad;

+ Coordinating with the Central Committee of the Vietnam Fatherland Front and central agencies of socio-political organizations in the performance of their tasks and powers
