New regulation: Simplification of procedures for issuing certificates of land use rights in Vietnam

On June 16, 2022, the Prime Minister of the Socialist Republic of Vietnam issued Decision 721/QD-TTg approving the plan to reduce and simplify regulations related to business activities under the state management functions of the Ministry of Natural Resources and Environment of Vietnam

According to the 2022-2025 roadmap, the registration and issuance of the Certificate of Land Use Rights, House Ownership, and Other Assets Attached to Land for individuals who receive land use rights transfer, purchase houses, or construction works in housing development projects will be reduced and simplified as follows:

- For provinces in Vietnam that have established Land Registration Offices:

+ Aiming to facilitate the procedures for citizens and businesses and contribute to shortening the time required compared to traditional procedures, a decision has been made to add an online public service submission method, depending on specific conditions regarding the information technology infrastructure and land database management at the local level.

+ Implement connectivity, data sharing, and electronic linkage between tax authorities, natural resources and environment agencies, the treasury, single-window, banks, or intermediary payment service providers to allow individuals and organizations to make online payments for land-related financial obligations through the online payment system of the National Public Service Portal.

The connectivity, data sharing, and electronic linkage enable individuals and organizations to make online payments for financial obligations in land administrative procedures, reducing paperwork, costs, and travel time to tax authorities, banks, single-window, or natural resources and environment agencies to receive tax notifications, pay financial obligations, and submit documents proving the completion of financial obligations in land administrative procedures. This connectivity and data sharing are entirely feasible based on the existing information systems, such as the online payment system of the National Public Service Portal, the tax database, the electronic single-window system of 63 provinces and cities connected and integrated with the National Public Service Portal, etc. Additionally, this has been successfully implemented for online payments of financial obligations in land administrative procedures for households and individuals on the National Public Service Portal.

- For cases where Land Registration Offices have not been established:

Furthermore, to ensure clarity, transparency, uniform application, and to avoid arbitrary requirements from receiving and processing administrative procedures agencies, the procedure for transferring investment capital, which is the value of land use rights, will be simplified by standardizing the document on the transfer of investment capital, which is the value of land use rights.

For this procedure, data sharing, connectivity, and electronic interlinking between tax authorities, natural resources and environment agencies, the treasury, single-window, banks, or intermediary payment service providers will be implemented to allow individuals and organizations to make online payments for land-related financial obligations through the online payment system of the National Public Service Portal.
