List of 10 repealed documents related to labor and wages from February 15, 2025 in Vietnam

The following article will provide information about the list of 10 legal documents related to labor and wages that have been entirely repealed by the Minister of Labor, War Invalids and Social Affairs of Vietnam.

On December 31, 2024, the Minister of Labor, War Invalids and Social Affairs of VIetnam issued Circular 15/2024/TT-BLDTBXH to abolish certain legislative documents promulgated by the Minister of Labor, War Invalids and Social Affairs, jointly issued, and effective from February 15, 2025.

List of 10 repealed documents related to labor and wages from February 15, 2025 in Vietnam

According to the provisions of Article 1 of Circular 15/2024/TT-BLDTBXH, the following 10 documents related to labor and wages, fully repealed from February 15, 2025, include:

(1) Circular 08/2013/TT-BLDTBXH guiding Decree No. 46/2013/ND-CP detailing the implementation of several provisions of the Labor Code on labor disputes.

(2) Circular 30/2013/TT-BLDTBXH guiding the implementation of several provisions of Decree No. 44/2013/ND-CP detailing the implementation of certain provisions of the Labor Code on labor contracts.

(3) Circular 19/2014/TT-BLDTBXH guiding the implementation of certain provisions of Decree No. 27/2014/ND-CP detailing the implementation of several provisions of the Labor Code on labor as domestic helpers.

(4) Circular 27/2014/TT-BLDTBXH guiding the labor state management agency in soliciting opinions from employee representative organizations, employer representative organizations at local levels in policy and legal development on labor and labor relations issues.

(5) Circular 23/2015/TT-BLDTBXH guiding the implementation of several provisions on wages of Decree No. 05/2015/ND-CP detailing and guiding the implementation of certain contents of the Labor Code.

(6) Circular 29/2015/TT-BLDTBXH guiding the implementation of several provisions on collective bargaining, collective labor agreements, and labor dispute resolution stipulated in Decree No. 05/2015/ND-CP detailing and guiding the implementation of certain contents of the Labor Code.

(7) Circular 35/2016/TT-BLDTBXH guiding the implementation of policies for employees when converting a public service provider into a joint-stock company according to Decision 22/2015/QD-TTg.

(8) Circular 17/2018/TT-BLDTBXH on self-inspection of the implementation of labor laws by enterprises.

(9) Circular 20/2018/TT-BLDTBXH guiding the coordination mechanism in implementing specialized labor, labor safety, and hygiene inspections at night, after working hours.

(10) Decision 01/2006/QD-BLDTBXH dated February 16, 2006, issuing the regulations on state labor inspection activities according to the method of regional inspector in charge.

Regulations on repealing the Implementation of legislative documents in Vietnam

According to Article 12 of the Law on Promulgation of legislative documents 2015 (amended by Clause 3 Article 1 of the Amended Law on Promulgation of legislative documents 2020), the modification, supplementation, replacement, abolition, or suspension of the implementation of legislative documents are regulated as follows:

- Legislative documents can only be modified, supplemented, replaced, or abolished by legislative documents of the same state agency that issued them or be suspended or abolished by documents of a competent state agency or individual. Documents modifying, supplementing, replacing, repealing, or suspending the implementation of other documents must clearly identify the name of the document, section, chapter, title, subtitle, article, clause, point of the document being modified, supplemented, replaced, abolished, or suspended.

Documents repealing legislative documents must be published in the Official Telegram and posted as regulated.

- When promulgating legislative documents, the issuing agency must simultaneously amend, supplement, abolish documents, sections, chapters, titles, subtitles, articles, clauses, points of legislative documents issued by themselves contrary to the new regulation; if immediate amendment or supplementation cannot be made, the new document must clearly determine the list of documents, sections, chapters, titles, subtitles, articles, clauses, points of legislative documents issued by them contrary to the new regulation, and there is a responsibility to amend, supplement before the new legislative document takes effect.

In cases where documents, sections, chapters, titles, subtitles, articles, clauses, points of legislative documents issued by them have provisions different from the new document but need to be continued to be enforced, they must be specified in the new document.

- One legislative document may be issued to simultaneously amend, supplement, replace, abolish contents in many legislative documents issued by the same agency in the following cases:

+ To implement related international treaties of which the Socialist Republic of Vietnam is a member;

+ The content of amendment, supplementation, replacement, or abolition is closely related to ensure unanimity, consistency with the newly issued document;

+ To implement a plan to simplify approved administrative procedures.
