Threat of Murder
1. Anyone who threatens to kill, if there are grounds for the threatened person to fear that the threat will be carried out, shall be subject to community sentence for up to 3 years or imprisonment from 6 months to 3 years.
2. If the crime falls under one of the following cases, the offender shall be subject to imprisonment from 2 years to 7 years:
a) Against 2 or more persons;
b) Abuse of position or authority;
c) Against a person performing an official duty or due to the victim's official duties;
d) Against a person under 16 years old;
dd) Concealing or avoiding handling another crime.
Thus, any individual who acts to threaten to kill another with grounds leading the threatened person to fear that the murder threat will be executed can be subject to criminal prosecution for the offense of threatening to kill, with penalties ranging from community sentence up to 3 years or imprisonment from 6 months to 7 years.
