What are regulations on working hours of drivers operating commercial and internal transport vehicle?

According to Article 64 of the Law Road Traffic Order and Safety 2024, the working hours of drivers operating commercial and internal transport vehicles are stipulated as follows:

- The driving hours for automobile drivers in Vietnam must not exceed 10 hours per day and not more than 48 hours per week; continuous driving must not exceed 04 hours, in compliance with the relevant regulations of the Vietnam Labor Code 2019.

- Transport business units, internal transport units, and automobile drivers engaged in commercial and internal transport in Vietnam are responsible for implementing the regulations in Article 64 of the Law Road Traffic Order and Safety 2024.

As of January 1, 2025, the driving hours for commercial and internal transport drivers will be limited to no more than 10 hours per day and no more than 48 hours per week; they must not drive continuously for more than 04 hours, in compliance with the relevant regulations of the Vietnam Labor Code 2019.

Based on point b, clause 5, and point a, clause 13, Article 21 of Decree 168/2024/ND-CP on the penalties for road traffic violations for operators of trucks, tractors (including trailers or semi-trailers), and similar vehicles for goods transportation in 2025:

Penalties, Driver License Points Deduction for Operators of Trucks, Tractors (including trailers or semi-trailers), and similar vehicles violating road traffic order and safety regulations for goods transport vehicles

5. A fine ranging from 3,000,000 VND to 5,000,000 VND shall be imposed for any of the following violations:

a) Operating a vehicle (including trailers and semi-trailers) transporting goods exceeding the permissible load (carrying mass) as stated in the technical safety and environmental protection certification by 30% to 50%;

b) Operating a commercial transport automobile beyond the stipulated time in clause 1, Article 64 of the Road Traffic Order and Safety Law; failing to comply with rest period requirements between continuous driving sessions;

c) Operating a commercial goods transport vehicle without an operational journey monitoring device, or having a monitoring device that is non-functional or manipulated to falsify data during transport as per regulations;

13. Beyond administrative penalties, violators will have points deducted from their driver's license as follows:

a) Violations specified in point b, point c, point d, clause 2; point a, clause 3; clause 4; clause 5; point c, point d, point d, clause 6 of this Article will incur a deduction of 02 points from the driver’s license;

b) Violations specified in point a, point b, clause 6; point c, point d, point d, clause 8; clause 10 of this Article will incur a deduction of 04 points from the driver’s license;

c) Violations specified in clause 9 of this Article will incur a deduction of 06 points from the driver's license;

d) Violations specified in clause 7 of this Article will incur a deduction of 08 points from the driver's license;

e) Violations specified in point a, point b, clause 8; clause 11 of this Article will incur a deduction of 10 points from the driver's license.

Thus, starting in 2025, automobile drivers who drive continuously for more than 04 hours will be fined from 3 million VND to 5 million VND.

In addition to administrative penalties, violators will also have 02 points deducted from their driving license according to legal provisions.
