According to the regulation in Article 7 of Decree 168/2024/ND-CP concerning penalties for blood alcohol concentration for motorbikes and mopeds in 2025, the fines are as follows:
According to Article 260 of the Criminal Code of Vietnam 2015 (amended in 2017) regarding violations of traffic safety regulations:
(1) Anyone participating in road traffic who violates traffic safety regulations causing harm to others in one of the following cases shall be fined from VND 30,000,000 to VND 100,000,000, face non-custodial reform for up to 3 years, or be imprisoned from 1 to 5 years:
- Causing death;
- Causing injury or harm to the health of one person with an injury rate of 61% or more;

(2) Committing an offense in one of the following cases shall be subjected to imprisonment from 3 to 10 years:
- No driver's license as required;
- While in a state of alcohol consumption with blood or breath alcohol concentration exceeding the regulated limits, or under the influence of drugs or other strong stimulants;
…
(3) Committing an offense in one of the following cases shall be subjected to imprisonment from 7 to 15 years:
- Causing death to 3 or more people;
- Causing injury or harm to the health of 3 or more people with a total injury rate of these individuals reaching 201% or more;
...
(4) Violations of road traffic regulations in cases that realistically can lead to consequences specified at one of points a, b, and c, clause 3, Article 260 of the Criminal Code of Vietnam 2015, as amended in 2017 if not promptly prevented, shall be fined from VND 10,000,000 to VND 50,000,000, face non-custodial reform for up to 1 year, or be imprisoned from 3 months to 1 year.
(5) The offender may also be prohibited from holding certain positions, practicing certain professions, or doing certain jobs for 1 to 5 years.
Thus, those who drink alcohol and ride motorbikes causing traffic accidents may face criminal liabilities including a fine from VND 30 million to VND 100 million, non-custodial reform for up to 3 years, or imprisonment ranging from 1 to 15 years depending on the severity of the consequences caused. Additionally, violators may be prohibited from practicing certain professions or holding certain positions for 1 to 5 years.
