1. How often does the Conference of officials and public employees occur in Vietnam?

According to Clause 1 Article 51 of the Law on Grassroots Democracy 2022, Conferences of officials and public employees, and employees are presided over by the head of the agency or unit and organized in cooperation with the union of the agency or unit.

Conferences of officials and public employees, and employees are held annually after the end of the working year of the agency or unit, but no later than 3 months into the following working year, as decided by the head of the agency or unit after consulting the union of the agency or unit.

In addition, Conferences of officials and public employees, and employees can be held extraordinarily upon the request of the entities specified in Clause 1 Article 50 of the Law on Grassroots Democracy 2022.

Thus, Conference of officials and public employees are organized annually but can also be held extraordinarily upon the request of authorized entities.

2. What are the contents of the Conferences of officials and public employees in Vietnam?

Based on Clause 3 Article 51 of the Law on Grassroots Democracy 2022, the contents of Conferences of officials and public employees at educational institutions for the 2024-2025 academic year will include:

- Reviewing the implementation of the guidelines and policies of the Communist Party, and the laws of the State related to the functions and tasks of the agency or unit;

- Reviewing the implementation of resolutions from previous Conferences of officials and public employees, and the regulations on the implementation of democracy at the agency or unit;

- Evaluating, summarizing, and reviewing the responsibilities of the head of the agency or unit in the implementation of the annual work plan;

- Summarizing the emulation movements, considering awards, and discussing and agreeing on the contents of the emulation for the next year; agreeing on the content of the emulation agreement;

- Discussing and deciding on the contents stipulated in Article 49 of the Law on Grassroots Democracy 2022. To be specific:

+ Electing or dismissing members of the People's Inspection Committee in the agency or unit.

+ The collection, expenditure, management, and use of contributions from officials and public employees, and employees at the agency or unit outside the legally mandated contributions.

+ The content of the resolutions from Conferences of officials and public employees, and employees.

+ Other internal self-managed activities that do not violate the provisions of the law and are consistent with social morals.

- Implementing the contents of information disclosure; soliciting opinions from officials and public employees, and employees on the contents stipulated in Article 53 of the Law on Grassroots Democracy 2022, specifically:

+ Solutions for implementing the guidelines of the Communist Party and the policies and laws of the State related to the functions and tasks of the agency or unit.

+ The annual work plan of the agency or unit.

+ The organization of the emulation movement of the agency or unit.

+ The midterm and annual reports of the agency or unit.

+ Measures to improve organization, activities, and working styles; preventing corruption and negativity; practicing thrift, combating wastefulness, and bureaucracy that causes inconvenience to the public.

+ Recruitment, training, and education plans for officials and public employees; elections and appointments of officials and public employees.

+ Implementing policies related to the rights and interests of officials and public employees, and employees.

+ Draft regulation on the implementation of democracy within the agency or unit.

+ Draft regulation on internal expenditure of the agency or unit (if any).

+ Other draft regulations and internal rules of the agency or unit.

+ Other matters as stipulated by law and the regulation on the implementation of democracy within the agency or unit.

- Implementing other tasks as decided by the conference.

3. Who are the participants of the Conference of officials and public employees in Vietnam?

Clause 2 Article 51 of the Law on Grassroots Democracy 2022 stipulates the participants of Conference of officials and public employees:

- For agencies or units with fewer than 100 officials and public employees, and employees, a general conference for all officials and public employees, and employees of the agency or unit is organized unless otherwise specified in points b and đ of this clause;

- For agencies or units with 100 or more officials and public employees, and employees, or with fewer than 100 but operating across a wide area or unable to leave their posts due to work obligations, the head of the agency or unit decides with the union whether the conference will include all officials and public employees, and employees or only representatives, suited to the specific circumstances of the agency or unit;

- A conference is valid if at least two-thirds of the total number of officials and public employees, and employees of the agency or unit or at least two-thirds of the total number of invited representatives are present. Resolutions and decisions of the conference are passed if more than 50% of the attendees approve, and the content complies with the law and social ethics;

- For agencies or units with affiliated entities, when organizing the conference, the head and representatives of the Executive Committee of the union of the affiliated entities may be invited if deemed necessary;

- Agencies or units with 7 or fewer officials and public employees, and employees may organize Conferences of officials and public employees, and employees if deemed necessary.
