Hung Kings Commemoration Day, also known as the Hung Temple Festival or National Ancestral Worship Day, is an important holiday in Vietnam to commemorate the contributions and preservation of the nation by the Hung Kings, the first kings of the country.

The festival takes place on the 10th day of the third lunar month every year at the historical site of the Hung Temple in Viet Tri city, Phu Tho province. History:

To honor the merits of the Hung Kings, King Le Thanh Tong in 1470 and King Le Kinh Tong in 1601 made replicas of the royal seals to be kept at the Hung Temple and designated the 11th and 12th days of the third lunar month as the Hung Kings Commemoration Days. During the Nguyen Dynasty, specifically during the reign of King Khai Dinh II, the 10th day of the third lunar month was officially chosen as the Hung Kings Commemoration Day to remember and worship the ancestors.

After the August Revolution in 1945, our Party and State have shown great interest in the Hung Temple. President Ho Chi Minh and other leaders have visited the temple. Following the noble tradition, especially the ethical principle of "remembering the source when drinking water," immediately after the successful revolution, President Ho Chi Minh signed Decree No. 22/SL-CTN on February 18, 1946, designating the 10th day of the third lunar month as a public holiday to participate in organizing activities for the Hung Kings Commemoration Day, which aims to connect with the roots of the nation.

On December 6, 2012, the world became aware of the Hung Kings Commemoration Day when UNESCO recognized the "Worship of the Hung Kings in Phu Tho" as an intangible cultural heritage representative of humanity. The 10th day of the third lunar month not only represents the tradition of remembering the source but also the pride of the Vietnamese people in front of the international community. There are a total of 1,417 temples dedicated to the Hung Kings throughout the country.

Significance:

2. How many days off are employees entitled to on the occasion of Hung Kings Commemoration Day 2024 in Vietnam?

According to the provisions of Article 112 of the Labor Code 2019 regarding holidays and New Year holidays as follows:

-  Employees shall be entitled to fully paid days off on the following public holidays:

+ Gregorian Calendar New Year Holiday: 01 day (the 1st of January of the Gregorian calendar);

+ Lunar New Year Holidays: 05 days;

+ Victory Day: 01 day (the 30th of April of the Gregorian calendar);

+ International Labor Day: 01 day (the 1st of May of the Gregorian calendar);

+ National Day: 02 days (the 2nd of September of the Gregorian calendar and the previous or next day);

+ Hung Kings Commemoration Day: 01 day (the 10th of the third month of the Lunar calendar).

- Foreign employees in Vietnam are entitled to 01 traditional public holiday and 01 National Day of their country, in addition to the public holidays stipulated in Clause 1 of Article 112 of the Labor Code 2019.

Currently, according to the 2024 calendar, March 10 of the lunar calendar will fall on Thursday, April 18, 2024.

Thus, according to the law, on Hung Kings Commemoration Day, employees will have 1 day off on Thursday, April 18, 2024 and employees will still be paid according to regulations.

3. Is it legal to take extra leave before or after Hung Kings Commemoration Day in Vietnam?

According to the provisions of Article 115 of the Labor Code 2019 on personal leave and unpaid leave as follows:

(1) An employee is entitled to take a fully paid personal leave in the following circumstances, as long as it is notified to the employer in advance:

- Marriage: 03 days;

- Marriage of his/her biological child or adopted child: 01 day;

- Death of his/her biological or adoptive parent; death of his/her spouse’s biological or adoptive parent; death of spouse, biological or adopted child: 03 days.

(2) An employee is entitled to take 01 day of unpaid leave and must inform the employer in the case of the death of his/her grandparent or biological sibling; marriage of his/her parent or natural sibling.

(3) The employee may negotiate with his/her employer on taking unpaid leave other than the leave stipulated in Clause (1) and (2) of this Section

Thus, employees and the employer can come to an agreement on taking unpaid leave. If approved by the employer, the employee can take additional leave before and after Hung Kings Commemoration Day, as agreed.
