According to the provisions in Clause 6, Article 1 of Circular 46/2024/TT-BCA (amending Article 11 of Circular 67/2019/TT-BCA) regarding the forms of citizen supervision on maintaining traffic order and safety:
Forms of citizen supervision
1. Citizens are entitled to supervise through the following forms:
a) Accessing public information from the Police force and through mass media;
b) Through supervising entities as stipulated by law;
c) Direct engagement and resolution of tasks with officers and soldiers;
d) Results of the resolution of cases, petitions, complaints, denunciations, proposals, and feedback;
dd) Direct observation of activities ensuring traffic order and safety.
2. Citizen supervision must meet the following conditions:
a) Not affecting the activities of officers and soldiers when they are on duty;
b) Not entering duty zones defined in Clause 2, Article 4 of this Circular, except for those with rights and duties related;
c) Compliance with other relevant legal provisions.
Meanwhile, under the current provisions (Article 11 of Circular 67/2019/TT-BCA), citizens can supervise traffic police through the following forms:
- Through public information of the Police and feedback via mass media.
- Through supervising entities as stipulated by law.
- Through direct engagement and resolution of tasks with officers and soldiers.
- Through results of the resolution of cases, petitions, complaints, denunciations, proposals, and feedback.
- Through recording and filming devices or direct observation, but must meet the following conditions:
+ Not affecting the normal activities of officers and soldiers when they are on duty;
+ Outside the areas ensuring traffic order and safety (in cases where such areas are deployed);
+ Compliance with other relevant legal provisions.
Thus, from November 15, 2024, regulations on supervising traffic police using recording and filming devices will be removed. However, the regulation on direct observation of the work ensuring traffic order and safety by the traffic police will still be maintained but must meet the conditions:
- Not affecting the activities of officers and soldiers when they are on duty;
- Not entering duty zones, except for those with rights and duties related.
- Compliance with other relevant legal provisions.
According to Article 9 of Circular 67/2019/TT-BCA (amended by Clause 5, Article 1 of Circular 46/2024/TT-BCA) on the responsibilities of citizens in participating in the activities to ensure traffic order and safety:
- Voluntarily complying with legal regulations on traffic order and safety; obeying the directions and instructions of traffic operators or controllers.
- Participating in the rescue and protection of the property of the victim, protecting the scene in traffic accidents.
- Protecting traffic works and traffic safety equipment. In case of discovering any works or equipment showing signs of not ensuring traffic safety or being damaged or violated, promptly signaling to the traffic participants and quickly notifying the nearest People's Committee, facility managing authority, or the nearest Police agency to promptly resolve.
- Detecting, preventing, and denouncing cases of violations of traffic order and safety.
- Notifying the Police or nearest People's Committee of traffic accidents, congestion; illegal racing, public disorder, criminal law violations affecting traffic safety; placing obstacles on roads, throwing stones, dirt, or other objects at vehicles or participants; illegally transporting flammable, explosive, narcotic substances or other illegal goods; impersonating the People's Police; obstructing officials in duty and other violations of traffic order and safety.
- Participating in and supporting the movements to maintain traffic order and safety; building a traffic culture.
- Supporting and assisting officers and soldiers when on duty.
- Propagating, educating, reminding other family members to comply well with legal regulations on traffic order and safety.
