What are the functions of the Ministry of Construction of Vietnam?

According to Article 1 of Decree 33/2025/ND-CP regarding position and function:

Article 1. Position and function

The Ministry of Construction is an agency of the Government of Vietnam, performing the function of state management over: construction planning, architecture; construction investment activities; urban development; technical infrastructure; housing; real estate market; building materials; transportation including road, railway, inland waterway, maritime, and civil aviation across the nation; state management of public services in the state management fields of the Ministry as prescribed by law.

Thus, the Ministry of Construction of Vietnam is an agency under the Government of Vietnam, with the function of state management in the fields of construction planning, architecture, construction investment, urban development, technical infrastructure, housing, real estate market, and building materials. Additionally, the Ministry also manages transportation by road, railway, inland waterway, maritime, civil aviation, and related public services as per legal regulations, to ensure sustainable and efficient development in the construction sector.

(10) Department of Economics - Construction Investment Management.

(11) Department of State Appraisal of Construction Quality.

(12) Department of Urban Development.

(13) Department of Construction Infrastructure Structure.

(14) Department of Housing and Real Estate Market Management.

(15) Road Department of Vietnam.

(16) Maritime and Inland Waterway Department of Vietnam.

(17) Civil Aviation Department of Vietnam.

Organizations listed from points 1 to 19 in this Article are bodies assisting the Minister in the execution of state management functions; the organizations listed from points 20 to 23 are public service providers serving the state's management function of the Ministry.

The Planning - Finance Department has 5 offices.

The Maritime and Inland Waterway Department of Vietnam, Civil Aviation Department of Vietnam, Road Department of Vietnam hold national emblem seal.

The Minister of Construction will issue decisions on functions, tasks, powers, and organizational structure of units under the Ministry; submit to the Prime Minister of the Government of Vietnam for decisions regarding the list of other public service providers under the Ministry as per regulations.

What are the duties and powers of the Ministry of Construction of Vietnam?

According to Article 2 of Decree 33/2025/ND-CP, the Ministry of Construction of Vietnam performs the tasks and exercises the powers as prescribed by the Law on the Organization of the Government of Vietnam, the regulations of the Government of Vietnam on the functions, tasks, powers, and organizational structure of the ministries and equivalent agencies, and specific tasks and powers. For example, concerning the real estate market, it is as follows:

- Lead and cooperate with ministries, equivalent agencies, and provincial People's Committees to develop proposals, policies for development, organization of implementation, and management of real estate business; measures to regulate the real estate market;

- Manage the issuance of real estate brokerage practice certificates, management of real estate brokerage activities; establishment and organization of the operation of real estate trading floors;

- Issue standard training programs, foster knowledge for real estate brokerage practice, operation of real estate trading floors; research the model of real estate trading floors managed by the state;

- Guide and inspect the implementation of laws on real estate business, conditions of organizations and individuals when doing real estate business, and conditions of real estate involved, and cooperate with provincial People's Committees to inspect and review real estate business activities as prescribed;

- Lead and cooperate with ministries, equivalent agencies, and provincial People's Committees in building, managing, operating the national information system on housing and real estate market; connecting and sharing information from housing and real estate market databases with national and other related specialized databases as prescribed by law; build and announce national real estate market evaluation indices;

- Appraise or provide opinions for the transfer of entire or part of real estate projects under the authority for review and decision by the Prime Minister of the Government of Vietnam; provide appraisal opinions on investment policies, adjust investment policies for real estate projects as regulated by the law on real estate business under the authority for approval of investment policies of the Prime Minister of the Government of Vietnam;

- Lead and cooperate with related agencies to implement anti-money laundering measures in real estate business according to legal provisions.
