According to Article 3 of the Social Insurance Law 2024, the term "mandatory social insurance" is explained as follows:

Article 3. Explanation of Terms

In this Law, the terms below are understood as follows:

1. Social insurance is the assurance to replace or compensate a portion of the income of social insurance participants when they face a reduction or loss of income due to sickness, maternity, occupational accidents, occupational diseases, retirement, or death, based on contributions to the social insurance fund or guaranteed by the state budget.

2. Social pension allowance is a type of social insurance guaranteed by the state budget for elderly individuals who meet the conditions prescribed by this Law.

3. Mandatory social insurance is a form of social insurance organized by the State, in which employees and employers who fall under the category of mandatory social insurance participants are required to participate.

According to Clause 1, Article 2 of the Social Insurance Law 2024, the employees who are Vietnamese citizens and fall under the category of mandatory social insurance participants include:

Article 2. Subjects of mandatory social insurance participation and voluntary social insurance

1. Employees who are Vietnamese citizens fall under the category of mandatory social insurance participants, including:

a) Individuals working under an indefinite-term labor contract, a definite-term labor contract with a term of at least 01 month, including cases where the employee and employer agree under another name but with content reflecting paid employment, salary, and management, direction, and supervision by another party;

b) Officials and public employees;

c) Workers and defense public employees, police workers, individuals performing other tasks in cryptographic organizations;

d) Officers, professional soldiers of the People's Army; officers, non-commissioned specialist officers, technical non-commissioned officers of the People's Public Security; individuals performing cryptographic duties receiving a salary equivalent to military personnel;

dd) Non-commissioned officers, enlisted soldiers of the People's Army; non-commissioned officers, enlisted soldiers obligated to serve in the People's Police; military, police, and cryptographic trainees receiving subsistence allowances;

e) Regular militia;

Therefore, according to the above regulations, as of July 2025, the regular militia will be included in the category of mandatory social insurance participants.

What documents are required to apply for sickness benefits when participating in mandatory social insurance in Vietnam?

According to Article 47 of the Social Insurance Law 2024, the application for sickness benefits is as follows:

(1) The application for sickness benefits for employees or employees' children receiving inpatient treatment includes the original or a copy of one of the following documents:

- Hospital discharge paper;

- Summary of the medical record;

- Other documents proving the inpatient treatment process.

(2) The application for sickness benefits for employees or employees' children receiving outpatient treatment includes one of the following documents:

- Certificate of leave for social insurance enjoyment;

- The original or a copy of the hospital discharge paper indicating the required time for outpatient treatment after inpatient treatment;

- The original or a copy of the summary of the medical record indicating the required time for outpatient treatment after inpatient treatment.

(3) The application for sickness benefits for employees or employees' children receiving medical examination and treatment abroad consists of medical examination and treatment documents indicating the disease name, treatment duration issued by the overseas medical facility and must meet the following requirements:

- Contains a Vietnamese translation notarized or certified in accordance with the law on notarization and certification;

- Is legalized, except in cases where an international treaty to which the Socialist Republic of Vietnam is a member contains different provisions.
