According to Article 4 of the Union Law 2024, the term “trade union member” is explained as follows:
Article 4. Interpretation of Terms
In this Law, the following terms are understood as follows:
1. Union rights are the rights to establish, join, and operate a union for employees, trade union members, and the rights of the Union organization as prescribed by law and by competent authorities.
2. A grassroots union is a fundamental organization of the Vietnam Union that gathers trade union members within one or several agencies, organizations, units, enterprises, recognized by the directly superior grassroots union or provincial union, central sector union, and equivalent according to the provisions of law and the Charter of the Vietnam Union.

6. A trade union member is an employee admitted or recognized into the Vietnam Union according to the Charter of the Vietnam Union.
7. An employer is an agency, organization, unit, enterprise, cooperative, cooperative alliance, household, individual hiring, recruiting, using employees, and paying wages, salaries according to the provisions of law.

Thus, a trade union member is an employee admitted or recognized into the Vietnam Union according to the Charter of the Vietnam Union.
Articles 21 and 22 of the Union Law 2024 specify the rights and responsibilities of trade union members as follows:
(1) Rights of a trade union member
- Request the Union to represent, protect legitimate and lawful rights and interests when infringed.
- Be informed, discuss, propose, and vote on the Union’s activities.
- Be propagated and informed about the Party's guidelines, the State's policies, and laws related to unions, employees, and Union regulations.
- Nominate, be nominated, and vote for the leadership bodies of the Union according to this Law and the Charter of the Vietnam Union.
- Question union leaders at various levels, propose disciplinary actions against union officials who violate according to the Charter of the Vietnam Union.
- Receive free legal support from the Union regarding union, labor, employment laws, social insurance, unemployment insurance, health insurance, safety, labor hygiene, officials and public employees.
- Be advised, guided, supported by the Union on finding jobs, vocational training, enhancing professional skills, and technical skills; be visited, assisted during illness, maternity, hardships, accidents, and enjoy other care and welfare activities conducted by the Union.
- Participate in cultural, sports, sightseeing, and tourism activities organized or coordinated by the Union.
- Propose to the Union to petition agencies, organizations, units, enterprises, cooperatives, cooperative alliances on the implementation of policies, laws for employees.
- Enjoy the policy of renting social housing of the Vietnam General Confederation of Labor.
- Be commended and rewarded for achievements in labor, production, and union activities.
- Other rights according to relevant laws and the Charter of the Vietnam Union.
(2) Responsibilities of a trade union member
- Comply with and implement the Charter of the Vietnam Union, resolutions, and Union's regulations; participate in union activities and strengthen the Union.
- Study to improve political, cultural, professional knowledge, skills, work ethic; cultivate working-class qualities; live and work according to the Constitution and law.
- Unite, assist colleagues in work and life; enhance labor productivity, quality, efficiency; protect the legitimate rights and interests of employees and the Union; contribute to building progressive, harmonious, and stable labor relations.
