From July 1, 2024, who must apply for replacement of identity cards in Vietnam?

When Law on Identification takes effect in Vietnam, is it mandatory to replace the current ID card with the new one? “Bao Anh-Long An”

Regarding this matter, LawNet would like to answer as follows:

1. From July 1, 2024, who must apply for replacement of identity cards in Vietnam?

Article 24 of the Law on Identification 2023 stipulates cases of replacement and re-issuance of identity cards.

In particular, cases of replacement and re-issuance of identity cards include:

- A Vietnamese citizen issued with an ID card shall carry out procedures for replacement of the card when he/she reaches from 14 years of age, 25 years of age, 40 years of age and 60 years of age.

- Information about family name, middle name, first name and date of birth is changed or corrected;

- Identity information is changed; information about portrait photo and fingerprints is added; gender re-assignment or transition is carried out according to regulations of law;

- There is incorrect information on the identity card;

- The card holder makes request when information on the ID card is changed due to arrangement of administrative units;

- Personal identification number is reset up;

- The card holder makes request.

At the same time, Article 46 of the Law on Identification 2023 stipulates:

- Citizen ID cards issued before the effective date hereof shall be valid until the expiry date specified in such cards, except for the case specified in Clause 3 of Article 46 of the Law on Identification 2023. The citizen ID cards will be replaced by ID cards at the request of citizens.

- 9-digit ID cards with expiration dates after December 31, 2024 are only valid until the end of December 31, 2024.

Issued legal documents which contain information of 9-digit ID cards and citizen ID cards shall remain valid; state agencies must not request citizens to change or adjust information of their 9-digit ID cards or citizen ID cards on the issued documents.

- 9-digit ID cards and citizen ID cards that expire from January 15, 2024 to before June 30, 2024 may remain valid until the end of June 30, 2024.

Thus, not everyone is required to apply for replacement of identity cards, they may still continue to use current 9-digit ID cards until they expire. Only people in the following cases must have their ID cards replaced:

+ Vietnamese citizens aged 14 years or older must complete procedures for issuance of identification cards

+ Citizens with chip-mounted citizen ID cards that will expire after July 1, 2024 and must go through procedures to replace the ID card.

+ People who are using 9-digit ID cards (9-digit ID cards with validity until December 31, 2024), after this date must carry out procedures for issuance and replacement of ID cards.

At the same time, if the citizens have a need, they can still apply for the procedure for replacement of ID cards

2. Are there any changes in ID cards compared to citizen ID cards in Vietnam?

According to Clause 2, Article 18 of the Law on Identification 2023, information printed on an ID card includes:

- A national emblem of the Socialist Republic of Vietnam;

- A phrase “CỘNG HÒA XÃ HỘI CHỦ NGHĨA VIỆT NAM, Độc lập - Tự do - Hạnh phúc” (THE SOCIALIST REPUBLIC OF VIETNAM, Independence - Freedom - Happiness);

- A phrase “CĂN CƯỚC” (IDENTIFICATION);

- Portrait photo;

- Personal identification number;

- Family name, middle name and first name;

- Date of birth;

- Gender;

- Place of birth registration.

- Nationality;

- Place of residence;

- Date of issuance; date of expiry;

- Issuing body: the Ministry of Public Security.

At the same time, persons eligible for issuance of ID cards according to Article 19 of the Law on Identification 2023 include:

- Persons eligible for issuance of ID cards are Vietnamese citizens.

- Vietnamese citizens from 14 years of age shall carry out procedures for issuance of ID cards.

- Vietnamese citizens under 14 years of age will be issued with ID cards if they have demands.

Thus, when changing from a Citizen ID card to an ID card, although the issued card number will not be changed, the Identification card form issued from July 1, 2024 will have some changes as follows:

- Card name changed from citizen ID card to ID card.

- Cardholder information:

+ People under 14 years old are also eligible for the issuance of the card;

+ Native place changed to Place of birth registration;

+ Place of permanent residence changed to Place of residence;

+ No longer shows fingerprints.

- The signature of the person issuing the card is changed from the Director of the Police Department for Administrative Management of Social Order (C06) of the Ministry of Public Security to Place of issue: Ministry of Public Security.
