Regarding this matter, LawNet would like to answer as follows:
From July 1, 2024, the Law on Identification 2023 will officially take effect. Thus, people in the following cases specified in Article 24 of the Law on Identification 2023 will have to replace their ID cards in Vietnam as of July 1, 2024:
- A Vietnamese citizen issued with an ID card shall carry out procedures for replacement of the card when he/she reaches 14 years of age, 25 years of age, 40 years of age and 60 years of age.
- Information about family name, middle name, first name, and date of birth is changed or corrected;
- Identity information is changed; information about portrait photo and fingerprints is added; gender re-assignment or transition is carried out according to regulations of law;
- There is incorrect information on the identity card;
- The card holder makes request when information on the ID card is changed due to arrangement of administrative units;
- Personal identification number is reset up;
- The card holder makes request.
However, Article 46 of the Law on Identification 2023 also clearly stipulates cases where it is not necessary to replace ID cards from July 1, 2024, including the following cases:
(1) Citizen ID cards issued before July 1, 2024 shall be valid until the expiry date specified in such cards;
(2) 9-digit ID cards with expiration dates after December 31, 2024 are only valid until the end of December 31, 2024
Thus, people with citizen identity cards/identity cards falling into cases (1) and (2) above are not required to replace their ID cards as of July 1, 2024, except in the following cases:
- The citizen identity cards/identity cards is damaged and cannot be used;
- There are changes in full name and identity information;
- There are changes in hometown and gender;
- There are errors regarding the information on the card;
- When Citizens need to replace the ID card to use a new type of personal document.
According to Clause 2 and Clause 3, Article 38 of the Law on Identification 2023, citizens are not required to pay fees for the initial issuance of ID cards. This regulation also applies to cases where people under 14 years old need to be issued an ID card.
In addition, in the following cases of card replacement, there is no need to pay the ID card replacement fee:
- A Vietnamese citizen issued with an ID card shall carry out procedures for replacement of the card when he/she reaches 14 years of age, 25 years of age, 40 years of age and 60 years of age
- The card holder makes request when information on the ID card is changed due to arrangement of administrative units;
- Incorrect information on ID cards due to faults of the identification-managing agency.
In the remaining cases, people will have to pay a fee when carrying out procedures for issuance and replacement of ID cards according to regulations.
In addition, Clause 4, Article 38 of the Law on Identification 2023 also clearly states that it is not required to collect charges for the issuance, replacement, and re-issuance of ID certificates to Vietnamese residents of undetermined nationality..
According to Article 27 of theLaw on Identification 2023, places where ID cards are issued, replaced, or re-issued in Vietnam include:
- Identification-managing agencies of police authorities of districts, urban districts, district-level towns, cities of provinces, cities of central-affiliated cities or identification-managing agencies of police authorities of provinces or central-affiliated cities where citizens are residing.
- ID cards shall be issued, replaced or re-issued at the identification-managing agency of the Ministry of Public Security in cases where the head of the identification-managing agency decides issuance, replacement or re-issuance of ID cards.
If necessary, identification-managing agencies shall organize implementation of procedures for issuance of ID cards at communes, wards, district-level towns, agencies, units or places of residence of citizens.
