What is the definition of adoption?

According to Article 3 of the Law on Adoption 2010 regarding the interpretation of terms related to adoption:

Article 3. Interpretation of terms

In this Law, the following terms are understood as follows:

1. Adoption is the establishment of a parent-child relationship between the adoptive parent and the adoptee.

2. Adoptive parents are those who have been registered by the competent state authority after the adoption process.

3. An adoptee is the person who is adopted once the adoption is registered by the competent state authority.

4. Domestic adoption is the adoption process between Vietnamese citizens who are permanently residing in Vietnam.

Thus, adoption is the establishment of a parent-child relationship between the adoptive person and the adoptee. This process must be registered by a competent state authority to officially recognize the adoption relationship. Adoptive parents are the individuals who adopt, while the adoptee is the one who is adopted after the legal registration of the adoption.

From January 08, 2025, what documents are included in the domestic adoptive parent's dossier in Vietnam?

According to Clause 4, Article 1 of Decree 06/2025/ND-CP amending Article 7 of Decree 19/2011/ND-CP governing the dossier for domestic adoption applicants:

The dossier for a domestic adoption applicant is compiled into one set, including the documents stipulated in Article 17 of the Law on Adoption 2010 and executed in the following manner:

(1) The applicant submits the dossier to the commune-level People's Committee with jurisdiction to resolve the adoption, via direct submission, mail, or online submission in accordance with legal regulations on executing administrative procedures in the electronic environment.

For the Judicial Record Card specified in Clause 3, Article 17 of the Law on Adoption 2010, the adoption applicant submits Judicial Record Card number 1.

(2) In cases where the adoption applicant submits the electronic Judicial Record Card, the commune-level People's Committee with jurisdiction to resolve the adoption can retrieve information and data on personal identity and marital status of the adoption applicant from the National Resident Database, and relevant specialized databases, thereby exempting the applicant from submitting physical copies of documents stipulated in Clauses 2, 3, and 4, Article 17 of the Law on Adoption 2010.

The search results are recorded by the commune-level People's Committee in either electronic form or paper form, reflecting fully and accurately the information at the time of the search, and attached to the dossier of the adoption applicant.

(3) For the document confirming family circumstances, housing status, and economic conditions of the adoption applicant as stipulated in Clause 5, Article 17 of the Law on Adoption 2010: If the permanent residence and current residence of the adoption applicant differ, within 2 working days from receiving the request from the adoption applicant, the commune-level People's Committee at the place of the adoptive applicant's permanent residence directly verifies within 5 working days or requests the commune-level People's Committee at the applicant's current residence to verify, evaluate the family circumstances, housing status, and economic conditions of the adoption applicant.

Within 5 working days from the receipt of the request, the commune-level People's Committee at the applicant's current residence conducts verification, evaluates according to the content of the confirmation document on family circumstances, housing status, and economic conditions of the adoption applicant, and notifies the results to the commune-level People's Committee at the place of the applicant's permanent residence.

Thus, the dossier for a domestic adoption applicant includes the following documents:

- Adoption application form;

- A copy of the passport, identity card, or a valid substitute document;

- Judicial Record Card number 1;

- Marriage status confirmation document;

- Health certificate issued by a district-level or higher medical authority; a document confirming family circumstances, housing status, and economic conditions issued by the commune-level People's Committee where the adoption applicant permanently resides, except as stipulated in Clause 3, Article 14 of the Law on Adoption 2010.
