From 2025, what are cases in which it is allowed to carry 2 people on a motorbike in Vietnam?

In the near future, when the Law on Road Traffic Order and Safety officially takes effect, what are cases in which it is allowed to carry 2 people on a motorbike in Vietnam?

1. From 2025, what are cases in which it is allowed to carry 2 people on a motorbike in Vietnam?

According to Clause 1, Article 33 of the Law on Road Traffic Order and Safety 2024 issued by the National Assembly of Vietnam, two-wheeled motorcycles and mopeds are only allowed to carry one person, except in the following cases where they can carry a maximum of two people:

(1) Transporting a person in need of emergency medical care;

(2) Escorting a person who has committed an illegal act;

(3) Children under 12 years old;

(4) Elderly or disabled persons.

Thus, compared to the Law on Road Traffic 2008 (currently in effect), the Law on Road Traffic Order and Safety 2024 adds the cases of elderly persons or disabled persons. Additionally, it specifies transporting children under 12 years old instead of under 14 as per the current regulations.

Prohibited behaviors for motorcycle operators and passengers while participating in traffic in Vietnam

According to Clauses 3 and 4, Article 33 of the Law on Road Traffic Order and Safety 2024, the following behaviors are prohibited for operators and passengers of two-wheeled motorcycles, three-wheeled motorcycles, and mopeds:

* For operators:

- Riding side by side;

- Riding in sections designated for pedestrians and other vehicles;

- Using umbrellas, mobile phones, audio devices, except hearing aids;

- Using the vehicle to tow or push other vehicles, objects, or carrying bulky items;

- Releasing both hands or riding with one wheel for two-wheeled motorcycles, or with two wheels for three-wheeled motorcycles;

- Other behaviors that disrupt traffic order and safety.

* For passengers:

- Carrying bulky items;

- Using umbrellas;

- Clinging to, towing, or pushing other vehicles;

- Standing on the seat, cargo rack, or sitting on the handlebars;

- Other behaviors that disrupt traffic order and safety.

In addition to the above prohibitions, motorcycle operators and passengers must properly wear helmets with securely fastened straps when participating in traffic.

2. What are principles must traffic participants comply with?

According to Article 3 of the Law on Road Traffic Order and Safety 2024 on ensuring road traffic order and safety, the principles are as follows:

- Complying with the Constitution, Vietnamese laws, and international treaties to which the Socialist Republic of Vietnam is a signatory.

- Ensuring orderly, safe, and smooth road traffic to contribute to socio-economic development, national desfense, security, and environmental protection; preventing violations of road traffic order and safety regulations, traffic accidents, and congestion; protecting the lives, health, and property of individuals, and the property of agencies and organizations.

- Ensuring road traffic order and safety is the responsibility of agencies, organizations, and individuals.

- Road traffic participants must comply with legal regulations on road traffic order and safety and other relevant laws, ensuring their own safety and the safety of others.

- All violations of road traffic order and safety regulations must be promptly detected, prevented, and strictly punished according to the law.

- Activities to ensure road traffic order and safety must be transparent, open, and convenient for the public.

- The work to ensure road traffic order and safety is carried out uniformly based on assignment, decentralization, and close coordination between relevant agencies, organizations, and individuals.

Thus, traffic participants must comply with several principles to ensure road traffic order and safety, such as adhering to the Constitution, Vietnamese laws, and international treaties to which Vietnam is a signatory, ensuring smooth road traffic, contributing to socio-economic development, and protecting the environment.
