According to the regulations in Article 46 of the 2024 Road Traffic Order and Safety Law issued by the National Assembly of Vietnam (effective from January 1, 2025) on ensuring road traffic order and safety for vehicles transporting preschool children and students, specifically as follows:
- Transport business vehicles carrying preschool children and students must meet the following requirements:
+ Ensure conditions specified in Clauses 1 and 2 of Article 35 of the 2024 Road Traffic Order and Safety Law; have devices to record images of preschool children and students and devices with functions to warn and prevent forgetting children on the vehicle; have a service life not exceeding 20 years; have paint color as stipulated by the Government of Vietnam;
+ Vehicles transporting preschool children or primary school students must have safety belts appropriate for their ages or use seats suitable for their ages as prescribed by law.
- Transport business vehicles combined with activities of transporting preschool children and students must meet the requirements specified in Clause 3 of Article 10, Clauses 1 and 2 of Article 35 of the 2024 Road Traffic Order and Safety Law; have devices to record images of preschool children and students and devices with functions to warn and prevent forgetting children on the vehicle meeting the requirements specified at Point a Clause 1 Article 46 of the 2024 Road Traffic Order and Safety Law.
- When transporting preschool children and primary school students, at least one supervisor must be arranged on each vehicle to guide, supervise, maintain order, and ensure the safety of preschool children and primary school students throughout the trip.
In cases where the vehicle has 29 seats or more (excluding the driver's seat) and transports 27 or more preschool children and primary school students, at least two supervisors must be arranged on each vehicle. Supervisors and drivers are responsible for checking preschool and primary school students upon exiting the vehicle; children must not be left on the vehicle when the supervisor and driver have disembarked.
- Drivers transporting preschool children and students must have at least two years of experience in passenger transport driving.
- Educational institutions must establish safe procedures for transporting preschool children and students; instruct drivers and supervisors to understand and correctly implement the procedures; and take responsibility for ensuring road traffic order and safety when organizing the transport of preschool children and students of that institution.
- Vehicles transporting preschool children and students are given priority in traffic flow organization, traffic regulation, and arrangement of stops and parking areas at educational institutions and points on the routes transporting preschool children and students.
Thus, from 2025, vehicles transporting preschool children and students must have devices to record images of children and warning devices to prevent forgetting children on the vehicle.
At the same time, supervisors and drivers are responsible for checking preschool and primary school students upon exiting the vehicle; children must not be left unattended on the vehicle when the supervisor and driver have disembarked.
According to Article 46 of the 2024 Road Traffic Order and Safety Law, some general traffic rules are as follows:
(1) Road traffic participants must keep to the right in the direction of travel, follow the correct lanes and road sections, comply with road signals, and adhere to other road traffic rules.
(2) Drivers and passengers in vehicles must fasten safety belts at positions equipped with safety belts when participating in road traffic.
(3) When transporting children under 10 years old and shorter than 1.35 meters in a vehicle, they must not sit in the same row of seats with the driver, except for vehicles with only one row of seats; the driver must use and instruct on the use of appropriate safety devices for children.
Thus, participants in Vietnam’s traffic must keep to the right in the direction of travel, follow the correct lanes, and comply with road signals. Drivers and passengers in vehicles must fasten safety belts. Children under 10 years old and shorter than 1.35 meters must not sit in the same row as the driver, except for vehicles with one row of seats, and must use appropriate safety devices.
