Compilation of judgments on red light running causing traffic accidents in Vietnam

1. Is the act of running a red light laible to criminal responsiblity in Vietnam?

According to Article 260 of the Criminal Code 2015 (amended by Clause 72 Article 1 of the Law amending the Criminal Code 2017), the crime of violating regulations on road traffic participation is as follows:

Crime of Violating Regulations on Road Traffic Participation

1. Anyone participating in road traffic who violates regulations on road traffic safety causing damage to another person in one of the following cases shall be fined from 30,000,000 VND to 100,000,000 VND, subject to non-custodial reform for up to 03 years, or imprisoned from 01 year to 05 years:

a) Causing death;

b) Causing injury or harm to the health of one person with a bodily injury rate of 61% or more;

c) Causing injury or harm to the health of two or more people with a total bodily injury rate of 61% to 121%;

d) Causing damage to property from 100,000,000 VND to less than 500,000,000 VND.

2. Committing the crime in one of the following cases shall be punishable by imprisonment from 03 years to 10 years:

a) Without a valid driver's license as prescribed;

b) Under the influence of alcohol with blood or breath alcohol concentration exceeding the prescribed limits, or using drugs or other strong stimulants;

c) Fleeing to evade responsibility or intentionally not helping victims;

d) Disobeying traffic controller or guide signals;

dd) Causing the death of 02 people;

e) Causing injury or harm to the health of two or more people with a total bodily injury rate of 122% to 200%;

g) Causing damage to property from 500,000,000 VND to less than 1,500,000,000 VND.

3. Committing the crime in one of the following cases shall be punishable by imprisonment from 07 years to 15 years:

a) Causing the death of 03 or more people;

b) Causing injury or harm to the health of three or more people with a total bodily injury rate of 201% or more;

c) Causing property damage of 1,500,000,000 VND or more.

4. Violating road traffic participation regulations in cases where actual potential exists for the consequences prescribed in points a, b, and c of clause 3 of this Article, if not promptly prevented, shall be fined from 10,000,000 VND to 50,000,000 VND, subject to non-custodial reform up to 01 year, or imprisonment from 03 months to 01 year.

5. The offender may also be banned from holding certain positions or practicing certain professions or doing certain jobs for 01 to 05 years.

Thus, anyone who runs a red light and causes a traffic accident that results in damage to another person, falling into one of the cases mentioned above, shall be prosecuted for criminal liability on the charge of violating road traffic participation regulations, with a penalty ranging from 01 year to 15 years in prison.

In addition, the offender may also be prohibited from holding certain positions, practicing a certain profession, or doing certain jobs for 01 to 05 years.
