According to Clause 12, Article 3 of Identity Law 2023 of Vietnam, an identity certificate is a personal document containing the identity of a person of Vietnamese origin whose nationality has not been determined, issued by the Identity Management Authority (IMA) as prescribed by the Identity Law 2023.
The identity certificate is issued to persons of Vietnamese origin whose nationality has not been determined and who have been continuously residing for 6 months or more in a commune-level administrative unit or district-level administrative unit where there is no commune-level administrative unit.
Based on the provisions of Article 24 of Decree 70/2024/ND-CP, the procedures for collecting, updating information of persons of Vietnamese origin whose nationality has not been determined into the National Database on Population, the Identity Database, and issuing identity certificates will be as follows:
Step 1: Persons of Vietnamese origin whose nationality has not been determined go to the IMA of the district police where they reside to request the collection and updating of information into the National Database on Population and the Identity Database.
Step 2: Fill in the information according to the Population Information Collection Form and provide other related documents and papers (if any), including:
- Documents and papers issued by Vietnamese agencies containing information about full name, date, month, year of birth;- Documents and papers proving blood relationship with persons who have or have had Vietnamese nationality;
In case the documents and papers are issued by foreign authorities, they must be legalized, except for cases exempted from consular legalization and translated, certified from foreign languages into Vietnamese.
Step 3: The IMA of the district police receives the declared information of persons of Vietnamese origin whose nationality has not been determined and collects biometric information such as fingerprints (except for children under 6 years old of Vietnamese origin whose nationality has not been determined), facial image, iris.
Step 4: Within 1 working day from the date the person of Vietnamese origin whose nationality has not been determined completes the information declaration as specified in Step 1, the IMA of the district police collaborates with relevant agencies, organizations, and individuals to verify the information declared by the person of Vietnamese origin whose nationality has not been determined.
The verification period is 30 days, and in complicated cases, it can be extended but not exceeding 60 days.
The residence registration agency where the person of Vietnamese origin whose nationality has not been determined lives is responsible for checking and verifying that the person has been continuously residing for 6 months or more in the locality.
Step 5: The IMA of the district police transfers the information of persons of Vietnamese origin whose nationality has not been determined to the IMA of the Ministry of Public Security for verification and comparison of information in the National Database on Population and the Identity Database.
Step 6: After verifying, checking, and comparing the information of persons of Vietnamese origin whose nationality has not been determined as prescribed in Step 4 and Step 5, the IMA of the district police collects, updates the information of persons of Vietnamese origin whose nationality has not been determined into the National Database on Population and the Identity Database for eligible cases; for ineligible cases, they must respond and state the reasons.
Step 7: Within 15 days from the date the IMA of the district police updates the information of persons of Vietnamese origin whose nationality has not been determined into the National Database on Population and the Identity Database, the IMA of the Ministry of Public Security must establish a personal identification number for persons of Vietnamese origin whose nationality has not been determined and issue an identity certificate to them.
Step 8: The IMA of the Ministry of Public Security sends the issued identity certificate to the IMA of the district police to deliver to the person of Vietnamese origin whose nationality has not been determined.
Article 26 of Decree 70/2024/ND-CP stipulates the procedures for reissuing and changing identity certificates in Vietnam as follows:
Step 1: Persons of Vietnamese origin whose nationality has not been determined go to the IMA of the district or provincial police where they reside to request the reissuance or change of the identity certificate, providing information including their full name, middle name, birth name, personal identification number, current residence for the receiver to check and compare information in the National Database on Population.
Step 2: The receiver checks and compares the information of the person requiring the reissuance or change of the identity certificate in the National Database on Population to correctly identify the information of the person requiring the reissuance or change of the identity certificate.
Step 3:
In case the information of the person requiring the reissuance or change of the identity certificate in the National Database on Population is incomplete or inaccurate, guide the person of Vietnamese origin whose nationality has not been determined to implement the collection, updating, and adjustment of information as prescribed in Article 24 of Decree 70/2024/ND-CP.
In case the information of the person requiring the reissuance or change of the identity certificate in the National Database on Population is complete and accurate, proceed to collect biometric information such as fingerprints, facial image, and iris (except for children under 6 years old of Vietnamese origin whose nationality has not been determined).
Step 4: Persons requiring an identity certificate check and sign the Identity Information Collection Form.
Step 5: The receiver issues a Receipt Card with a deadline for returning the results of the identity certificate application.
Step 6: Return the identity certificate at the location specified in the Receipt Card; in cases where the person requesting the identity certificate asks to receive it at another location, IMA delivers the identity certificate to the requested location, and the person must pay the delivery service fee.
Step 7: Recollect the used identity certificate in cases of change of identity certificate.
