The Editorial Board provides the following explanation:
On July 1, 2024, The Identity Law of Vietnam will officially come into effect, detailing the cases in which identity cards must be issued, replaced, or reissued, along with the procedures and processes for doing so as follows:
Article 24 of The Identity Law stipulates the cases requiring the replacement of identity cards, including:
- Cases specified in Clause 1, Article 21 of The Identity Law (Vietnamese citizens who have been issued an identity card must follow the procedure to replace the card when they reach the ages of 14, 25, 40, and 60 years).
- Changes or corrections to information about surname, middle name, given name; date, month, year of birth.
- Changes in appearance; adding information about facial photos, fingerprints; gender reassignment or sex change in accordance with the law.
- Inaccuracies in the information printed on the identity card.
- Upon the request of the cardholder when the information on the identity card changes due to administrative unit reorganization.
- Re-establishing the personal identification number.
- When the cardholder requests it.
- Loss of the identity card or damage rendering the card unusable, except for the cases specified in Article 21 of The Identity Law.
- Regaining Vietnamese nationality in accordance with the law on Vietnamese nationality.
Based on Article 25 of The Identity Law, the procedures and processes for replacing or reissuing identity cards are as follows:
- The process for reissuing an identity card for the cases specified at Point b, Clause 2, Article 24 of The Identity Law and for replacing identity cards is carried out according to the provisions of Article 23 of The Identity Law.
- In cases requiring the replacement of identity cards due to gender reassignment, sex change, or changes and corrections to information as specified at Point b, Clause 1, Article 24 of The Identity Law, where such information has not been updated or adjusted in the National Population Database, the person needing an identity card must provide legal documents and materials that prove the changed information for the update and adjustment in the National Population Database.
- The identity management agency will collect the old identity cards or citizen identity cards used in the cases of replacing identity cards.
- The reissuance of identity cards in the cases specified at Point a, Clause 2, Article 24 of The Identity Law is conducted online through the public service portal, national identification application, or directly at the place where the identity card procedures are handled. The identity management agency uses the latest collected facial photo, fingerprint, iris information, and the existing information in the National Population Database, Identity Database to reissue the identity card.
