A fine of up to 1 billion VND for importing scrap containing radioactive substances into Vietnam

The Government of Vietnam promulgated Decree 45/2022/ND-CP stipulating penalties for administrative violations in the field of environment, in which the act of importing radioactive scraps; Importing scrap not on the list of scrap allowed to be imported, will be fined from 900 million VND to 1 billion VND for individuals.

At the same time, Vietnam's Decree 45 also stipulates a fine range from VND 100-130 million shall be imposed on warehouses or storage yards importing scrap for failing to meet environmental protection requirements in importing scrap as raw production materials; for storing imported scrap in an area other than a warehouse or storage yard that has been granted an environmental permit.

The fine amount will increase to VND 130-150 for not having a warehouse or storage yard importing scrap that meets the conditions on environmental protection in importing scrap for use as raw production materials; for not directly signing contracts with foreign organizations and individuals to supply imported scrap as raw production materials.

Similarly, a fine range from VND 150-170 million shall be imposed for one of the following acts:

- There is no technology and equipment to recycle and reuse scrap as prescribed;

- Failing to treat impurities accompanying the scrap or not transferring impurities to a unit with the processing function as prescribed;

- Failing to identify and classify waste generated from the process of using imported scrap in order to have an appropriate waste treatment plan according to regulations.

A fine of between VND 170-200 million shall be imposed for importing scrap in excess of the permitted volume in the environmental permit;

A fine of between VND 200-230 million shall be imposed for using imported scrap in contravention of regulations;

A fine ranging from VND 230 to VND 250 million shall be imposed for importing scrap that is not of the right type as prescribed.

The fine level in the above acts will be doubled for the organization.

In addition, Decree 45 also stipulates additional sanctions such as suspension of import of scrap for use as raw production materials; forcible re-export or destruction in case it is impossible to re-export for violations.

In addition, the Decree also mentions that additional penalties can be applied such as deprivation of the right to use environmental permits for a definite time; certificate of eligibility for environmental monitoring services.

Decree 45/2022/ND-CP takes effect from August 25, 2022.
