According to Article 2 of Circular 259/2016/TT-BTC stipulating the payers of fees and charges for licensing of the exportation of workers on fixed-term basis as follows:
- Companies, organizations and individuals shall incur the relevant fee defined in this Circular upon applying to competent government authorities for verification of the documents concerning Vietnamese workers taking up overseas employment.
- Companies and organizations shall incur the charge defined in this Circular upon the issuance, replacement or re-issuance of their license for exporting workers on contract basis.
- Department of Overseas Labour (Ministry of Labour, Invalids and Social affairs) and Vietnam’s overseas missions shall collect the fee and charge (Article 3 of Circular 259/2016/TT-BTC)

- According to the provisions of Section 19, Article 1 of Circular 44/2023/TT-BTC, 50% reduction of fees and charges for licenses the provision of Vietnamese guest worker services on fixed-term basis and verification of documents and papers requested by domestic organizations and individuals
- For the case of verification of papers and documents at the request of foreign organizations and individuals receiving Vietnamese workers, the fee rates according to Circular 259/2016/TT-BTC still apply.
- At the same time, a 50% reduction on rate of fees and charges for granting operation permits to send workers to work abroad applied from July 1, 2023, to the end of December 31, 2023.
* Objects that are exempt from paying fees
Individuals from poor and near-poor households, and permanent residents from ethnic minority groups in economically and socially underdeveloped communes shall be exempt from the fee for verification of documents upon request of local persons working overseas.
According to Article 6 of Circular 259/2016/TT-BTC, the deadline for declaring and paying fees and charges applicable to fee-collecting organizations is as follows:
- If overseas missions of Vietnam collect the fee:
= On no later than the fifth of each month, the collectors shall submit 70% the fee amount collected in the previous month into the temporary state budget fund of such overseas missions.
= The collectors shall exchange the fee amount collected in the currency of their host countries to US dollar (USD) at the USD selling rate announced by the bank at which such overseas missions open their account and then submit the exchanged amount to their temporary state budget fund.
- If the Department of Overseas Labour collects the fee or charge:
= On no later than the fifth of each month, the collector shall deposit the fee amount collected in the previous month into the budgetary contribution account at the State Treasury.
