07 prohibited acts in electronic payment activities for road traffic in Vietnam

Which actions are prohibited in electronic payment activities for road traffic in Vietnam? What documents are included in the application for opening a traffic account in Vietnam?

On September 30, 2024, the Government of Vietnam issued Decree 119/2024/ND-CP (effective from October 1, 2024) regarding electronic payment for road traffic. The Decree includes regulations on the necessary information required in the road traffic account application that the vehicle owner must provide.

According to Article 5 of Decree 119/2024/ND-CP, the following acts are prohibited in electronic payment for road traffic:

(1) Destroying, forging, erasing data, or tampering with the content of terminal cards; transferring terminal cards from one participating vehicle to another.

(2) Intruding or attempting to intrude, sabotage, steal data, or unlawfully alter software programs and electronic data used in electronic payment for road traffic; exploiting network system errors for profit.

(3) Providing false information during participation in electronic payment activities for road traffic.

(4) Disclosing or providing information related to personal data contrary to legal requirements.

(5) Opening or maintaining anonymous or impersonated traffic accounts.

(6) Deliberate evasion or fraud in electronic payment for road traffic.

(7) Unfair competition among electronic payment service providers for road traffic.

Thus, the 07 prohibited acts in electronic payment for road traffic from October 1, 2024, include destruction of terminal cards, system intrusion, providing false information, illegal disclosure of personal data, use of anonymous/impersonated accounts, payment fraud, and unfair competition among service providers.

What documents are included in the application for opening a traffic account in Vietnam?

According to Clause 2, Article 43 of Road Traffic Law 2024 regarding traffic accounts:

"A traffic account is an account opened for the road vehicle owner and connected to a legal payment method to facilitate cashless payments in accordance with banking laws."

If a vehicle owner needs to make electronic payments for road traffic, they must register a traffic account. In such cases, the vehicle owner must prepare the traffic account application to proceed with registration.

Based on Article 11 of Decree 119/2024/ND-CP, the traffic account application must ensure the provision of complete traffic account information as in the Appendix of Decree 119/2024/ND-CP, including the following information:

- Traffic account number, opening date of the traffic account.

- Information about the traffic account holder (for individual account holders): Full name; date of birth; gender; nationality; contact address; personal identification number; registered phone number; registered email.

- Information about the traffic account holder (for organizational account holders): Organization name; establishment decision or operation license or enterprise registration certificate; contact address; registered phone number; registered email.

- Information about the vehicle with terminal card: License plate, chassis number, engine number, load capacity, seating capacity, vehicle type; technical safety inspection certificate and environmental protection; proof of priority vehicle (if applicable).

- Information about the terminal card: Terminal card identification number (TID); electronic product code of the terminal card (EPC); installation date of the terminal card.

- Information about cashless payment methods: Type of payment method; payment method number; service provider of the payment method.

Vehicle owners must provide and update complete and accurate information in the traffic account application as stated above to the payment service provider for road usage and are responsible for the truthfulness of the information provided.

The payment service provider for road usage is responsible for checking, verifying, and confirming the vehicle owner's information through the national residential database for individual owners and by cross-examining documents for organizational owners.
