What is overseas study counseling service business under the law in Vietnam?

Overseas study counseling service business is stipulated in Clause 2, Article 106 of Decree 46/2017/ND-CP which includes the following activities:

[1] Introduction and consultation on educational policies of countries and territories; advising on the selection of schools, courses, disciplines, and levels that are suitable for the capabilities and aspirations of the learners;

[2] Organizing advertising, conferences, seminars, fairs, and exhibitions related to studying abroad as per legal regulations;

[3] Organizing recruitment and enrollment for studying abroad;

[4] Organizing training of necessary skills for Vietnamese citizens to study abroad;

[5] Organizing the dispatch of Vietnamese citizens to study abroad, facilitating parents or guardians to visit training institutions abroad as per legal regulations;

[6] Other activities related to the business of study abroad counseling services.

What are the conditions and procedures for doing overseas study counseling service business in Vietnam ? 

Based on the provisions of Article 107 of Decree 46/2017/ND-CP (content repealed by Article 2 Decree 135/2018/ND-CP), the conditions for doing business in study abroad counseling services are as follows:

*Conditions for overseas study counseling service business

- Staff directly counseling for study abroad must have a university degree or higher; be proficient in using at least one foreign language at Level 4 or higher according to the Vietnamese six-level foreign language proficiency framework or equivalent; possess a certificate of study abroad counseling professional training prescribed by the Ministry of Education and Training.

* Procedures for obtaining a certificate of business registration for study abroad counseling services (Article 108 of Decree 46/2017/ND-CP, amended by Clause 44, Article 1 of Decree 135/2018/ND-CP) are as follows:

- The Director of the Department of Education and Training issues the certificate of business registration for study abroad counseling services to the organization registering said business.

- The dossier includes:

+ A written request for the issuance of a certificate of business registration for study abroad counseling services, with primary content including: Objectives, activities; capacity to exploit and develop study abroad services; plans and measures for implementation; solutions for handling risks to those consulting for study abroad;

+ A certified copy from the original register, a notarized copy of the original or a copy with the original for comparison of the enterprise registration certificate, establishment decision, or investment registration certificate;

+ A list of staff directly counseling for study abroad with key information: Full name, date of birth, gender, professional qualifications, foreign language proficiency, job positions at the organization providing study abroad counseling services; certified copy from the original register, notarized copy, or copy with the original for comparison of the university diploma, foreign language certificate, certificate of study abroad counseling professional training.

- The process of implementation:

+ The organization doing business in study abroad counseling services submits directly or via post 01 dossier as specified in Clause 2, Article 108 of Decree 46/2017/ND-CP, amended by Clause 44, Article 1 of Decree 135/2018/ND-CP to the Department of Education and Training where the business is headquartered;

+ Within 15 working days from the date of receipt of a valid dossier, the Director of the Department of Education and Training examines the dossier, verifies the documents' authenticity, and issues a business registration certificate for study abroad counseling services; if the conditions are not met, a written notification will be sent to the organization specifying the reasons.

- During its operation, the organization doing business in study abroad counseling services should request the Department of Education and Training to adjust, supplement the certificate of business registration for study abroad counseling services. The procedure for adjusting, supplementing the certificate is done as specified in Clause 3, Article 108 of Decree 46/2017/ND-CP, amended by Clause 44, Article 1 of Decree 135/2018/ND-CP.
