What is extra class?

Pursuant to Article 2 of the Regulation on Extra Class issued together with Circular 17/2012/TT-BGDDT, the following provisions are stipulated:

Explanation of Terms

1. Extra class is the extra teaching and learning activity that charges learners, with content according to the general education program but outside the education plan of the general education program issued by the Ministry of Education and Training.

2. Extra class in schools is extra teaching and learning organized by public educational institutions (including: general education institutions; vocational training centers; continuing education centers; community learning centers; foreign language and IT centers, hereinafter collectively referred to as schools).

3. Extra class outside of schools is extra teaching and learning not organized by the educational institutions stipulated in clause 2 of this article.

Extra class is the additional teaching activity that charges learners.

The content is taught according to the general education program but outside the education plan of the general education program.

Recently, on August 22, 2024, the Ministry of Education and Training published a Draft Circular on the Regulation of Extra Class on its electronic information portal for public feedback. The consultation period will last until October 22, 2024.

The Draft Circular on the Regulation of Extra Class comprises 4 Chapters and 16 Articles, specifically as follows:

In the latest Draft Circular on the Regulation of Extra Class, there are no provisions on cases where extra class is prohibited.

Thus, if there are no changes and the latest Draft Circular on the Regulation of Extra Class is approved, it will replace Circular 17/2012/TT-BGDDT. In addition, there will be no cases of prohibited extra classes.

What are the prohibited cases of extra classes under the current regulations?

According to the provisions of Article 4 Regulation on Extra Class issued together with Circular 17/2012/TT-BGDDT, the following cases are prohibited from extra classes:

- No extra classes for students who are organized by the school to study 2 sessions a day.

- No extra classes for primary school students, except for cases of fostering in arts, physical education, sports, and life skills training.

- Higher education institutions, colleges, professional secondary schools, and vocational schools are not allowed to organize extra classes according to the general education program.

- For teachers receiving salaries from the public service provider salary fund:

+ Not allowed to organize extra classes outside schools but can participate in supplementary teaching outside schools;

+ Not allowed to teach outside schools to students whom the teacher is teaching in the mainstream class without the permission of the head of the managing teacher authority.

What are regulations on inspection, examination, and handling of violations in extra class activities in Vietnam?

The regulations on inspection, examination, and handling of violations in extra class activities are as follows:

*Inspection, examination (Article 21 of the Regulation on Extra Class issued together with Circular 17/2012/TT-BGDDT)

Extra class activities are subject to inspection and examination by education management agencies, state inspection agencies, relevant specialized inspection agencies, and local authorities.

*Handling of violations (Article 22 of the Regulation on Extra Class issued together with Circular 17/2012/TT-BGDDT)

- Educational institutions, organizations, individuals violating the regulations on extra classes, depending on the nature and extent of the violation, will be subject to administrative sanctions or criminal prosecution as prescribed.

- Heads of agencies, organizations, units; officials and public employees managed by the State violating regulations on extra classes will be subject to disciplinary action in accordance with regulations.
