Based on Article 6 of the Student Affairs Regulations for regular university education programs issued together with Circular 10/2016/TT-BGDDT, students are not allowed to do following acts:

Acts students are not allowed to do

  1. Insulting dignity, honor, infringing upon the bodies of teachers, administrators, public employees, staff, other learners of higher education institutions, and other persons.

2. Cheating in learning, checking, and exams such as: copying, bringing documents into the exam room, asking for grades; studying, taking exams, internships, and duties for others or asking others to study, take exams, internships, and duties; copying, asking or doing thesis, projects, or theses for others; organizing or participating in organizing exam taking for others or other forms of cheating.

  1. Smoking, drinking alcohol, beer in the school; coming to class intoxicated.
  1. Organizing or participating in illegal gatherings, demonstrations, or complaints; participating in social evils, causing disorder in higher education institutions or in society.
  1. Organizing or participating in illegal racing or cheering for illegal racing.
  1. Organizing or participating in gambling in any form.
  1. Producing, trading, transporting, disseminating, storing, using or inciting others to use weapons, explosives, drugs, prohibited substances; documents, publications, and information that are reactionary, pornographic, or otherwise prohibited by the state; organizing, participating in, or spreading superstitious activities, religious activities within higher education institutions; and other immoral acts.
  1. Establishing or participating in illegal political activities; organizing or participating in collective activities in the name of higher education institutions without the permission of the head of the higher education institution.
  1. Posting, commenting, and sharing posts, images with vulgar, violent, pornographic content; infringing national security, opposing the Communist Party and the state, distorting, slandering, and offending the reputation of organizations, honor, and dignity of individuals on the Internet.
  1. Organizing or participating in other illegal activities.

Based on Article 9 of the Student Affairs Regulations for regular university education programs issued together with Circular 10/2016/TT-BGDDT, the forms of discipline and content of violations are stipulated as follows:

Forms of discipline and content of violations

1. Students who commit violations may be reminded, criticized, or subjected to one of the following forms of discipline, depending on the nature, severity, and consequences of the violation:

a) Reprimand: applicable to students who commit a minor violation for the first time;

b) Warning: applicable to students who have been reprimanded but repeat the violation or commit a minor violation frequently or for the first time but the violation is relatively serious;

c) Temporary suspension of studies: applicable to students who continue to violate discipline while under warning or commit serious prohibited acts; students who violate the law and are sentenced to probation. Depending on each specific case, the head of the higher education institution may decide the suspension period according to levels: suspension for one semester, suspension for one academic year, or suspension for the duration of the probation.

d) Expulsion: applicable to students who continue violating discipline while under suspension or commit a severe and serious violation affecting the higher education institution and society; sentenced to imprisonment.

  1. Disciplinary actions from warning and above must be recorded in the student management file and notified to the student's family. In the case of a suspension or expulsion, the higher education institution must send a notification to the student's locality and family for coordination in management and education.
  1. Violation content and disciplinary framework shall be in accordance with the appendix attached to this regulation.

Thus, regular university students allowing others to copy thesis is not permitted. What are procedures for disciplining university students in Vietnam?

Based on Clause 1, Article 10 of the Student Affairs Regulations for regular university education programs issued together with Circular 10/2016/TT-BGDDT, the procedures for disciplining university students are stipulated as follows:

- Students who commit violations must write a self-critique and self-assess the form of discipline. If the student does not comply, the Student Reward and Discipline Council will still convene to handle based on the collected evidence;

- The class monitor organizes a meeting with the class, analyzes the violation, and proposes a disciplinary form to the faculty or student affairs unit;

- The faculty or student affairs unit considers and proposes to the Student Reward and Discipline Council of the higher education institution;

- The Student Reward and Discipline Council convenes to evaluate the discipline, including members of the council, representatives of the class with the violating student, and the violating student. If the violating student is invited but does not attend without a valid reason, or does not submit a self-critique, the council will still convene and consider additional discipline for lack of organizational consciousness.

The council recommends a disciplinary form and proposes the head of the higher education institution to issue a written disciplinary decision.

Do university students in Vietnam have the right to appeal against disciplinary actions?

Based on Article 13 of the Student Affairs Regulations for regular university education programs issued together with Circular 10/2016/TT-BGDDT, the right to appeal against rewards and disciplines is stipulated as follows:

The right to appeal against rewards and disciplines

Individuals and student groups who find that rewards and disciplines are not satisfactory have the right to appeal to functional departments or the head of the higher education institution; if the higher education institution has reviewed but remains unsatisfactory, they may appeal to higher authorities as per the law on complaints and denunciations.

Thus, university students have the right to appeal against disciplinary actions if they find the measures unsatisfactory, to functional departments or the head of the higher education institution. If the review by the higher education institution remains unsatisfactory, they may appeal to higher authorities as per the law on complaints and denunciations.
