Contribution rate and responsibilities under the provisions of Article 85 and Article 86 of the Law on Social Insurance and guiding documents. To be specific:

  1. Contribution rate and responsibilities of workers

1.1. Workers stipulated in Points 1.1, 1.2, 1.3, 1.4, 1.5, and Sub-point b Point 1.7 Clause 1 Article 4, each month contribute 8% of the monthly salary to the retirement and survivorship fund.

1.2. Workers stipulated in Point 1.6 Clause 1 Article 4, each month contribute 8% of the statutory pay rate to the retirement and survivorship fund.

Thus, the social insurance contribution rate for primary school teachers is 8% of the monthly salary.

Is the seniority allowance for primary school teachers in Vietnam included in the social insurance contribution rate?

Based on Article 4 Decree 77/2021/ND-CP, the seniority allowance rate is as follows:

Seniority Allowance Rate

  1. Educators participating in teaching, education with compulsory social insurance contributions for 5 years (60 months) are entitled to a seniority allowance of 5% of the current salary plus the leadership position allowance and seniority allowance beyond the framework (if any). From the sixth year onward, each year (full 12 months) adds 1%.
  1. The seniority allowance is paid along with the monthly salary period and is used to calculate contributions and benefits of social insurance, health insurance, and unemployment insurance.

Thus, the seniority allowance for primary school teachers is included in the social insurance contribution rate.

When are primary school teachers in Vietnam eligible for retirement pension?

Based on Clause 1 Article 54 Law on Social Insurance 2014, the conditions for entitlement to retirement pension are as follows:

Conditions for entitlement to retirement pension

  1. Workers stipulated in points a, b, c, d, g, h, and i of Clause 1 Article 2 of this Law, except for the cases stipulated in Clause 3 of this Article, when ceasing work, have paid social insurance for 20 years or more, and fall into one of the following cases:

a) Reached the age prescribed in Clause 2 Article 169 of the Labor Code;

b) Reached the age prescribed in Clause 3 Article 169 of the Labor Code and have paid social insurance for at least 15 years doing heavy-duty, hazardous, dangerous jobs or especially heavy-duty, hazardous, dangerous jobs on the list issued by the Ministry of Labor - Invalids and Social Affairs, or have paid social insurance for at least 15 years working in areas with extremely difficult socioeconomic conditions, including the period of working in areas with regional allowances with a coefficient of 0.7 or more before January 1, 2021;

c) Workers who are younger than the retirement age by no more than 10 years prescribed in Clause 2 Article 169 of the Labor Code and have paid social insurance for at least 15 years doing coal mining work in underground mines;

d) People infected with HIV

Based on point c Clause 1 Article 2 Law on Social Insurance 2014, the applicable subjects are as follows:

Thus, primary school teachers are eligible for retirement pension when falling into one of the following cases:

- Reached the age prescribed in Clause 2 Article 169 of the Labor Code 2019;

- Reached the age prescribed in Clause 3 Article 169 of the Labor Code 2019 and have paid social insurance for at least 15 years doing heavy-duty, hazardous, dangerous jobs or especially heavy-duty, hazardous, dangerous jobs on the list issued by the Ministry of Labor - Invalids and Social Affairs, or have paid social insurance for at least 15 years working in areas with extremely difficult socioeconomic conditions, including the period of working in areas with regional allowances with a coefficient of 0.7 or more before January 1, 2021;

- Infected with HIV
