Pursuant to Clause 1, Article 7 of Circular 02/2022/TT-BGDDT regulating the construction, proposal, and approval of the policy to establish new majors:

Construction, Proposal, and Approval of Policy to Establish New Majors

1. The director, institute head, or the rector of the educational institution (collectively referred to as the rector) shall direct and organize the construction and proposal of policies regarding the establishment of a new major.

Thus, according to the above regulation, when a university wishes to establish a new major, the director, institute head, and rector of the educational institution, collectively referred to as the Rector, are responsible for constructing the proposal.

What contents are included when the rector of a university proposes the policy for a new major in Vietnam?

According to Clause 2, Article 7 of Circular 02/2022/TT-BGDDT, the content that must be included when the rector of a university proposes the policy for a new major is as follows:

[1] On the necessity of proposing the policy to establish the major: Report analyzing and explaining the training needs, the demand for workforce serving the current labor market and in the near future; analyze and forecast workforce needs in quantity and quality, survey the competency requirements of graduates desired by employers, and the scope of workforce market according to the major; analyze global trends in the academic field, alignment with the development of the sector and educational level of the institution, alignment with the mission and strategic goals of the institution, and strategies for economic-social development planning of the sector, localities, regions, and the nation;

[2] On the capabilities of the educational institution: Report analyzing and explaining the existing capabilities of the institution for the proposed academic field and level, including faculty team, infrastructure, learning materials, training programs, scientific research, corporate cooperation, and international collaboration;

[3] On the development goals of the proposed major: Report explaining the expected outcomes regarding the time of major establishment, the timeline for implementation of the training program, training objectives, recruitment plans, training scale in the next 5 to 10 years, training quality, efficacy, and societal impact;

[4] On implementation solutions and roadmap: Report explaining solutions and roadmaps for constructing the proposal of the major, developing the training curriculum, infrastructure investment needs, technology, and learning materials, faculty recruitment and development plans, training program evaluation, and accreditation plans;

In addition, the body vested with the authority to appraise the proposal for establishing an undergraduate major as stipulated in Clause 3, Article 7 of Circular 02/2022/TT-BGDDT is the Scientific and Educational Council of the educational institution.

Similarly, the approval of the policy for establishing an undergraduate major at an educational institution is conducted in accordance with Clause 4, Article 7 of Circular 02/2022/TT-BGDDT as follows:

- Based on the proposed major policy that has been appraised and concluded by the Scientific and Educational Council in accordance with Clause 3 of this Article, the rector shall report to the school board for approval; the university president shall report to the university board for approval for majors involving multiple participating member units. The school board and university board are responsible for:

+ Ensuring that the proposed major development orientation aligns with the development orientation of the educational institution, meets the workforce demand of ministries, sectors, localities, the nation, and aligns with international integration;

+ Guaranteeing resources to effectively implement the major proposal;

+ Evaluating risk forecasts, proposing preventative measures, and solutions for resolving issues in case of risks in establishing the major.

In case the educational institution lacks a school board, the institution shall submit the proposal to the managing agency for approval and shall bear the responsibility for managing, overseeing, and supervising the construction and implementation of the major proposal.

What are the responsibilities of the rector of a higher education institution in Vietnam?

Pursuant to Clause 1, Article 20 of the Higher Education Law 2012 (amended by Clause 14, Article 1 of the Higher Education Law Amendment 2018), the responsibilities of the rector of a higher education institution are as follows:

- The rector of a university or the director of a university (collectively referred to as the rector of a higher education institution) is the individual responsible for managing and administering all activities of the higher education institution in accordance with the law, organizational regulations, and the operation of the higher education institution.

- The rector of a public higher education institution is appointed by the school board or university board and recognized by the competent management agency; the rector of a private higher education institution, or non-profit private higher education institution is appointed by the school board or university board.

- The term or appointment duration of the rector of a higher education institution is decided by the school board or university board within the scope of the term of the school board or university board.
