Who Has the Authority to Decide the Establishment of a Pedagogical College in Vietnam?

The authority to decide on the establishment of a pedagogical college is stipulated in Article 4 of the Charter of Pedagogical Colleges issued together with Circular 23/2022/TT-BGDĐT as follows:

Management of Pedagogical Colleges

1. pedagogical colleges in this Charter include: central pedagogical colleges and local pedagogical colleges, in which:

a) Central pedagogical colleges are under the Ministry of Education and Training; directly managed by the Ministry of Education and Training, and simultaneously under the territorial administration of the provincial People's Committee where the main campus and branches are located;

b) Local pedagogical colleges are under the provincial People's Committee; directly managed by the provincial People's Committee.

2. pedagogical colleges are established by the Pedagogical College of Vietnam; subjected to state management of education by the Ministry of Education and Training for the group of teacher training faculties; subjected to state management of vocational education by the Ministry of Labor, War Invalids and Social Affairs when participating in the training of sectors and professions within the state management scope of the Ministry of Labor, War Invalids and Social Affairs.

3. The provincial People's Committee is responsible for cooperating with the Ministry of Education and Training in carrying out state management according to their functions, tasks, and assignments of the Government of Vietnam for pedagogical colleges as stipulated in this Charter and other relevant legal regulations.

Thus, according to the above regulations, the Pedagogical College of Vietnam is authorized to decide the establishment of a pedagogical college.

Does the Organizational and Operational Regulations of a Pedagogical College in Vietnam Include Mission Objectives?

The main content of the organizational and operational regulations of a pedagogical college is prescribed in Article 5 of the Charter of Pedagogical Colleges issued together with Circular 23/2022/TT-BGDĐT as follows:

Organizational and Operational Regulations of Pedagogical Colleges

1. The organizational and operational regulations of a pedagogical college include the following main contents:

a) Name of the college, abbreviation (if any);

b) Objectives and mission;

c) Organization and management of the college;

d) Organization of training activities, scientific research, technology, international cooperation, and quality assurance activities;

đ) Duties and rights of lecturers, management staff, public employees, and workers;

e) Duties and rights of students;

g) Finance and assets;

h) Relations between the pedagogical college and educational institutions, enterprises, families, and society;

i) Inspection, examination, publicity, supervision, commendation, and handling of violations.

2. The principal of the pedagogical college is responsible for organizing the construction of the organizational and operational regulations of the pedagogical college based on the specific conditions of the college and in compliance with current legal regulations. The regulations must be consulted widely among management staff, lecturers, students, workers of the college, and related parties, ensuring transparency and accountability, be advised by the scientific and training council, and must be decided upon by the college council. Based on the resolution of the college council, the principal will issue the organizational and operational regulations of the pedagogical college, which must be publicly available on the college's website at least 45 days before implementation.

3. Within 10 working days from the date of issuance of the organizational and operational regulations of the pedagogical college, the principal must send them to the following agencies:

a) Ministry of Education and Training;

b) Direct management agency of the pedagogical college;

c) Department of Education and Training of the provinces or centrally managed cities where the main campus is located.

Thus, according to the above regulations, one of the contents of the Organizational and Operational Regulations of a pedagogical college will include objectives and mission.

The organizational structure of a pedagogical college is stipulated in Article 7 of the Charter of Pedagogical Colleges issued together with Circular 23/2022/TT-BGDĐT as follows:

Organization, Establishment, Termination of Operations, Dissolution of Organizations of Pedagogical Colleges

1. The organization of a pedagogical college includes:

a) College council;

b) Principal, vice-principal;

c) Functional departments or specialized, operational units;

d) Faculties, subjects;

đ) Scientific and training council and other advisory councils (if any);

e) Practice schools or practice facilities (if any);

g) Branch campuses, research and development organizations; public service providers, business and service production facilities (if any).

2. The establishment, termination of operations, and dissolution of branch campuses of a pedagogical college shall comply with the regulations of the Government of Vietnam regarding investment conditions and operations in the field of education.

3. The establishment, dissolution of subordinate units, and organizations under a pedagogical college, stipulating their organizational structure, tasks, and powers shall comply with current legal regulations, stipulations in this Charter, and must be specified in the organizational and operational regulations of the college.

The organizational structure of a pedagogical college includes:

- College council.- Principal, vice-principal.- Functional departments or specialized, operational units.- Faculties, subjects.- Scientific and training council and other advisory councils (if any).- Practice schools or practice facilities (if any).- Branch campuses, research and development organizations; public service providers, business and service production facilities (if any).

Thus, it can be seen that a pedagogical college will have branch campuses.
