Based on Clause 2, Article 5 of the Charter of the Ho Chi Minh Communist Youth Union 2022, the regulations are as follows:
The Ho Chi Minh Communist Youth Union organizes and operates according to the principle of democratic centralism:
- The leading agencies of each level of the Union are elected, and collective leadership is practiced along with individual accountability.
- The highest leading agency of the Union is the National Representative Congress. The governing body of the Union at each level is the representative congress or the member congress at that level. Between congresses, the governing body is the Executive Committee elected by the congress of the same level; between meetings of the Executive Committee, the governing body is the Standing Committee elected by the Executive Committee of the same level. The number of members of the Executive Committee at each level is decided by the Congress of that level according to the guidance of the Central Standing Committee of the Union. The number of members of the Standing Committee shall not exceed one-third of the number of members of the Executive Committee. At the central level, the number of Secretaries of the Central Union shall not exceed one-third of the number of members of the Standing Committee.
- The resolutions of the Union must be strictly adhered to: lower levels must comply with higher levels, the minority must comply with the majority, and individuals must comply with the organization.
Thus, the highest leading agency of the Ho Chi Minh Communist Youth Union is the National Representative Congress. The term of the National Representative Congress of the Ho Chi Minh Communist Youth Union is 5 years, convened by the Central Executive Committee of the Union.
The Central Executive Committee of the Union is allowed to adjust the term of the National Representative Congress with the consent of the Central Secretariat of the Vietnam Communist Party.

How many levels are there in the organizational system of the Ho Chi Minh Communist Youth Union in Vietnam?
Based on Article 6 of the Charter of the Ho Chi Minh Communist Youth Union 2022, the organizational system of the Union consists of 4 levels:
- Central level.
- Provincial and equivalent level.
- District and equivalent level.
- Grassroots level (including grassroots unions and grassroots chapters).
The establishment, division, merger, consolidation, or dissolution of a Union organization is decided by the directly superior Union level.
How to handle the case where the Ho Chi Minh Communist Youth Union election is not conducted in accordance with principles?
In Article 8 of the Charter of the Ho Chi Minh Communist Youth Union 2022:
- The election of the Union is conducted by secret ballot or voting. Particular elections for the Executive Committee and its positions; the Inspection Committee and its positions; delegates to the higher-level Union Congress are conducted by secret ballot.
- The election list must be discussed and approved by the congress or representative meeting through voting.
- During elections, more than one-half (1/2) of the attendees’ approval is required for a candidate to be elected. If multiple candidates receive more than one-half (1/2) of the votes, those with the highest vote count are elected. If the results show multiple candidates with more than one-half (1/2) of the votes and the same number of votes, but the number of candidates exceeds the required number, a re-election among those candidates is held; the candidate with the highest votes is elected, even if not exceeding one-half (1/2). If the re-election results in a tie, further elections are decided by the congress or meeting.
- The grassroots union congress and the congresses of other levels can directly elect the Secretary with the approval of the directly superior Union level and the Communist Party committee of the same level.
- The Central Standing Committee of the Union sets the principles, procedures, and process for elections.
- If the election is not conducted in accordance with the stated principles and procedures, a re-election must be organized.
The elections of the Union are conducted by secret ballot or voting. Particular elections for the Executive Committee and its positions; the Inspection Committee and its positions; delegates to the higher-level Union Congress are conducted by secret ballot.
If the elections of the Ho Chi Minh Communist Youth Union are not carried out according to the stipulated principles and procedures, a re-election must be organized.
