1. The direct management agency facilitates individuals to participate in teaching, scientific research, and academic exchange activities abroad through promoting cooperation in education and scientific research with foreign educational institutions and science and technology organizations.

2. Vietnamese citizens accepted or invited by foreign entities for teaching, scientific research, and academic exchange need to communicate with the foreign party to specifically agree on the following:

a) For teaching: Subject content or topic, teaching duration, and financial and insurance responsibilities of the parties;

b) For scientific research: Research content or research topic, research method, time abroad, and financial and insurance responsibilities of the parties;

c) For academic exchange: Exchange program or academic exchange project, exchange method, time abroad, and financial and insurance responsibilities of the parties.

3. The direct management agency issues the decision to send Vietnamese citizens abroad for teaching, scientific research, and academic exchanges. In case the direct management agency does not have sufficient authority to issue the decision, it must report to the competent authority to issue the decision to send Vietnamese citizens abroad for teaching, scientific research, and academic exchanges.

What are rights of Vietnamese citizens going abroad for academic exchanges?

Based on Clause 1, Article 19 of Decree 86/2021/ND-CP, the rights of Vietnamese citizens going abroad for academic exchanges are:

- Protected by Vietnamese representative agencies abroad regarding their lawful rights and interests according to Vietnamese law, the host country’s law, and international law and practices during their academic exchange period abroad;

- Allowed to transfer their salary, wages, income, and other personal assets back to Vietnam according to Vietnamese law and the host country’s law;

- If they are employees of agencies or organizations enjoying the state budget, they are entitled to enjoy salaries, wages, other incomes, healthcare policies, social insurance, and other benefits based on agreement with the direct management agency and are welcomed back to work after completing their tasks abroad.

a) Exercise rights in cooperation with foreign countries according to Article 44 of the 2012 Law on Higher Education, Article 47 of the 2014 Law on Vocational Education, and Article 71 of the 2013 Law on Science and Technology;

b) Organize the sourcing, selection, training, and dispatch of persons for teaching, scientific research, and academic exchanges abroad;

c) Require persons sent for teaching, scientific research, and academic exchanges abroad to comply with agency regulations or agreements between the two parties before going abroad (if any);

d) Require persons sent for teaching, scientific research, and academic exchanges abroad to report work results during their time abroad.
