Pursuant to Article 15 of Decree 90/2020/ND-CP, amended by Clause 4, Article 1 of Decree 48/2023/ND-CP, the regulation is as follows:

Criteria for Rating the Quality of Public Employees at the Level of Failing to Perform Duties

  1. A non-management public employee falls into the category of failing to perform duties if they meet any of the following criteria:

a) Exhibits signs of ideological, political, ethical, lifestyle degradation, self-evolution, self-transformation as assessed by the competent authority;

b) Fails to meet more than 50% of the criteria for task performance results according to the signed work contract, planned agenda, or specific assigned tasks in terms of progress, quality, and effectiveness;

c) Engages in behaviors subject to disciplinary actions within the review year;

  1. A management public employee falls into the category of failing to perform duties if they meet any of the following criteria:

a) Exhibits signs of ideological, political, ethical, lifestyle degradation, self-evolution, self-transformation as assessed by the competent authority;

b) Fails to meet more than 50% of the criteria for task performance results according to the signed work contract, planned agenda, or specific assigned tasks in terms of progress, quality, and effectiveness;

c) The unit or field of work under their responsibility achieves less than 50% of the targets, tasks;

d) The unit under their direct management, authority is involved in embezzlement, corruption, wasteful practices and is prosecuted as per legal regulations;

đ) Engages in behaviors subject to disciplinary actions within the review year.

Thus, if a teacher is subject to disciplinary actions within the review year, the teacher will be rated as failing to perform duties, regardless of the number of violations.

Procedure for rating teachers without management positions in Vietnam

Pursuant to Clause 2, Article 19 of Decree 90/2020/ND-CP, the regulations are as follows:

Procedure for Assessing and Rating the Quality of Public Employees

...

  1. For non-management public employees:

a) The public employee conducts a self-assessment, rating their quality

The public employee prepares a report self-assessing their work results according to the assigned tasks, as per the form No. 03 in the Appendix attached to this Decree.

b) Commenting and assessing the public employee

A meeting is organized at the unit where the public employee works to comment and assess the public employee.

The meeting attendees include all public employees of the unit or all public employees of the constituent unit where the public employee works if the unit has constituent units.

The public employee presents the self-assessment report at the meeting, and the attendees give their comments, which must be recorded in the minutes and passed in the meeting.

c) Reviewing and deciding the assessment, rating the quality of the public employee

The competent authority, based on the comments at the meeting mentioned at Point b of this Clause, decides on the assessment content and the quality rating level for the public employee.

d) The competent authority informs the public employee in writing and publicly announces in the agency, organization, or unit where the public employee works about the assessment and quality rating results; decides on the form of public announcement in the agency, organization, or unit where the public employee works, prioritizing the form of public announcement in the electronic environment.

Thus, the procedure for rating teachers without management positions is as follows:

Step 1: The teacher conducts a self-assessment and rates their quality.

Step 2: Organize a meeting at the unit where the teacher works to comment and assess the teacher.

Step 3: Review and decide on the assessment and quality rating of the teacher.

Step 4: The competent authority informs the teacher in writing and publicly announces in the agency, organization, or unit where the teacher works about the assessment and quality rating results; decides on the form of public announcement in the agency, organization, or unit where the teacher works, prioritizing the form of public announcement in the electronic environment.

What is the use of teacher assessment results in Vietnam?

Pursuant to Article 21 of Decree 90/2020/ND-CP, the regulations are as follows:

Usage of Assessment Results for Officials and Public Employees

The assessment and quality rating results for officials and public employees serve as a basis for arranging, utilizing, training, fostering, promoting, or upgrading the professional title, planning, appointing, relieving duties, transferring, rotating, seconding, rewarding, disciplining, assessing and rating the quality of party members, and implementing other policies for officials and public employees.

Thus, the teacher assessment results are used as a basis for arranging, utilizing, training, fostering, promoting the professional title, planning, appointing, relieving duties, transferring, rotating, seconding, rewarding, disciplining, assessing and rating the quality of party members, and implementing other policies for teachers.
