What things should be done and should not be done during Mid-Autumn Festival in 2024 in Vietnam?
Mid-Autumn Festival is a traditional festival in East Asia that originated from Chinese culture. However, upon being introduced to Vietnam, it has acquired a unique and indescribable charm.
Mid-Autumn Festival, also known as Children's Festival, Moon Festival, or Reunion Festival, is a day when children participate in fun and beneficial activities such as lantern parades, feasts, and lion dances, among others.
Mid-Autumn Festival falls on the 15th day of the 8th lunar month every year.
Today is Monday, September 9, 2024 (Gregorian calendar), equivalent to August 7 (lunar calendar). Thus, there are 7 days left until Mid-Autumn Festival in 2024 (Tuesday, September 17, 2024, will be the 15th day of the 8th lunar month).
Youngsters and parents should note some dos and don'ts for Mid-Autumn Festival in 2024 as follows:

Are students entitled to a day off during the Mid-Autumn Festival?
There is currently no specific regulation for students to have a day off on Mid-Autumn Festival.
Additionally, based on Article 112 Labor Code 2019 regarding holidays:
Holidays
1. Employees are entitled to days off work with full pay on the following holidays:
a) New Year: 01 day (January 01, Gregorian calendar);
b) Lunar New Year: 05 days;
c) Victory Day: 01 day (April 30, Gregorian calendar);
d) International Labor Day: 01 day (May 01, Gregorian calendar);
dd) National Day: 02 days (September 02, Gregorian calendar and 01 consecutive day either before or after);
e) Hung Kings' Commemoration Day: 01 day (March 10, lunar calendar).
2. Foreign employees working in Vietnam, in addition to the days off specified in Clause 1 of this Article, are entitled to 01 traditional national holiday and 01 National Day of their country.
3. Annually, based on actual conditions, the Prime Minister of Vietnam will decide the specific holidays as specified at points b and dd of Clause 1 of this Article.
Employees are entitled to days off work with full pay on the following holidays and Tet:
- New Year: 01 day (January 01, Gregorian calendar);
- Lunar New Year: 05 days;
- Victory Day: 01 day (April 30, Gregorian calendar);
- International Labor Day: 01 day (May 01, Gregorian calendar);
- National Day: 02 days (September 02, Gregorian calendar and 01 consecutive day either before or after);
- Hung Kings' Commemoration Day: 01 day (March 10, lunar calendar).
Therefore, Mid-Autumn Festival is not one of the holidays during which employees are entitled to a day off.
Since students typically follow teachers' schedules, and based on the above regulation, teachers do not have a day off on Mid-Autumn Festival in 2024.
Thus, students will also not get a day off on Mid-Autumn Festival.
What are rights of students' in Vietnam?
For primary school students
According to Article 35 of the Regulations on Primary Schools issued with Circular 28/2020/TT-BGDDT, primary school students have the following rights:
- To receive education:
+ To be educated, and to study for comprehensive development and to best utilize their potential; to study at a school and class that implements the primary education curriculum conveniently for them within their residential area.
+ Students can choose or transfer to schools outside their residential area if the school is capable of accepting them.
+ Students of primary school age returning from overseas, children of foreigners studying and working in Vietnam, children facing difficulties who have not attended school can be accepted into a primary school, with the principal conducting a survey to place them in an appropriate class.
+ Disabled students can integrate into a primary school and are ensured conditions to study and exercise; they are evaluated according to their personalized education plan.
+ Students can shorten the program time, study at a higher age level, extend study time, or repeat grades.
+ Talented and intellectually advanced students can skip grades within the educational level. Procedures include:
++ Parents or guardians submit a request to the school.
++ The school principal forms an advisory committee including parents' representatives; current and next grade teachers, medical staff, and club leaders.
++ Based on the survey results, the principal completes the dossier and reports to the Head of the Department of Education and Training for consideration.
+ Students with limited academic performance, despite direct guidance and help from teachers and parents or guardians, might not meet the academic and training requirements. Teachers will report to the principal for consideration regarding promotion or repetition, in consultation with the family to decide appropriate educational measures.
- To be protected, cared for, respected, and treated equally and democratically; to their legitimate rights and interests; to receive full information on their academic and training progress; and to ensure conditions about time, facilities, hygiene, and safety for studying and exercising.
- To engage in activities that enhance their abilities; to express personal opinions and aspirations.
- To receive scholarships and social policies according to regulations.
- To enjoy other rights as per the law.
For lower and upper secondary school students
According to Article 35 of the Regulations issued with Circular 32/2020/TT-BGDDT, lower and upper secondary school students have the following rights:
- Equality in receiving comprehensive education, assurance of conditions regarding time, facilities, hygiene, and safety for on-class and self-study; to be informed of their learning and training; and to use the school's facilities and equipment for educational, cultural, and athletic activities according to regulations.
- To be respected and protected, treated equally and democratically; to complain to the school and educational management levels about decisions affecting themselves; to transfer schools for valid reasons according to current regulations; to advance in grades, skip grades, or study at older ages as specified in Article 33 of the Regulations issued with Circular 32/2020/TT-BGDDT.
- To participate in activities developing their skills in subjects, sports, and arts organized by the school if eligible.
- To receive scholarships or other allowances as prescribed for students eligible for social policies, those facing life challenges, and those with special talents.
- To transfer schools if eligible, following the transfer procedures regulated by the Minister of Education and Training.
- To enjoy other rights as provided by law.
