According to the provisions of Article 47 Decree 46/2017/ND-CP (amended by Clause 20, Article 1 Decree 135/2018/ND-CP), the procedures for establishing a foreign language and informatics center are as follows:

- Authority to establish the foreign language and informatics center:

+ The Director of a university, academy, the President of a university, or the Principal of a pedagogical college decides to establish a foreign language and informatics center within the campus of the institution;

+ The head of a social organization, social-professional organization, or economic organization legally allowed to establish affiliated training centers has the authority to decide on the affiliated foreign language and informatics centers;

+ The Director of the Department of Education and Training decides to establish affiliated foreign language and informatics centers; allows the establishment of foreign language and informatics centers affiliated with universities, academies, university colleges, pedagogical colleges located outside the campus of the institution, and the foreign language and informatics centers stipulated in point b clause 1 Article 47 Decree 46/2017/ND-CP.

- Procedure implementation:

Step 1: The organization or individual submits directly or via postal service 01 set of application documents to the competent authority for establishing a foreign language and informatics center;

Documents include:

- Petition proposing the establishment of a foreign language and informatics center;

- Scheme for establishing the foreign language and informatics center containing the following information: The center's name, location, necessity and legal basis for the establishment, objectives, and tasks of the center; curriculum, training scale; infrastructure; organizational structure; and résumé of the proposed centre's Director;

- Draft internal regulations for the organization and operation of the foreign language and informatics center.

Step 2:

- Within 10 working days from the date of receipt of a complete application, the competent authority establishing the foreign language and informatics center is responsible for reviewing and inspecting according to regulations;

- Within 05 working days, the authority competent to decide on the establishment, as prescribed in clause 1 Article 47 Decree 46/2017/ND-CP, will decide to establish or permit the establishment if conditions are met; if the decision is not to establish, a written notice with justification is provided to the organization or individual.

According to Article 48 Decree 46/2017/ND-CP (amended by Clause 21, Article 1 Decree 135/2018/ND-CP), the operating conditions for a foreign language and informatics center in Vietnam are as follows:

- Having a management team, teachers, and staff that meet the required standards, and being able to meet the operational needs of the center.

- Having suitable infrastructure, equipment, curriculum, teaching materials, and appropriate financial resources ensuring education quality according to the development plan and operating scale of the center.

What are procedures for operation of a foreign language and informatics center in Vietnam?

According to Article 49 Decree 46/2017/ND-CP (amended by Clause 22, Article 1 Decree 135/2018/ND-CP), the procedures for operation of a foreign language and informatics center in Vietnam are as follows:

- Authority for permitting educational activities (1)

+ The Director of the Department of Education and Training decides to permit educational activities for the foreign language and informatics centers stipulated in points b and c clause 1 Article 47 Decree 46/2017/ND-CP;

+ The Director of a university, academy; the President of a university; or the Principal of a college decides to permit educational activities for foreign language and informatics centers operating within the campus of the institution.

- Procedure implementation:

Step 1: The foreign language and informatics center submits directly or via postal service 01 set of application documents to the competent authority specified in (1).

Documents include:

- Petition proposing permission for educational activities;

- A copy issued from the original register, an authenticated copy, or a copy accompanied by the original for comparison of the establishment decision issued by the competent authority;

- Internal regulations for educational activities of the center;

- Report on infrastructure, equipment, curriculum, teaching materials; management, teaching staff; legal documents proving the lawful use of land, buildings; financial resources ensuring the operation of the center.

Step 2: Within 05 working days from the date of receipt of the application, the competent authority reviews the documents. If the documents are unsatisfactory, a written notice specifying required adjustments or supplements is issued to the center;

Step 3: Within 10 working days from the date of receipt of compliant documents, the competent authority coordinates with relevant agencies and units to organize on-site inspections to evaluate compliance with set conditions and records the results in an appraisal minutes;

Within 05 working days from the date of appraisal results, the competent authority decides to permit the center's educational activities. If a decision is not made to permit educational activities, a written notice with justification will be issued to the center.
