What is visiting lecturing in Vietnam?
According to the provisions of Clause 1, Article 2 of the Regulations on policies for visiting lecturing in educational institutions issued together with Circular 44/2011/TT-BGDDT, visiting lecturing refers to the act of educational institutions inviting teachers or individuals who meet the qualifications of teachers as stipulated to:
- Teach subjects or modules specified in the preschool, general education, regular education, vocational secondary education, and university education programs;
- Teach specialized topics;
- Guide, participate in grading, dissertation defense boards, graduation thesis councils; guide, participate in master's thesis, doctoral dissertation evaluation councils;
- Guide experiments, practice, internships according to education programs;
- Participate in the development and design of training programs, compile textbooks, teaching materials, and reference books.

What are the standards for visiting lecturers in Vietnam?
Based on Article 5 of the Regulations on policies for visiting lecturing in educational institutions issued together with Circular 44/2011/TT-BGDDT, the standards for visiting lecturers are as follows:
- For teaching subjects, topics included in preschool, general education, vocational secondary education, higher education, and regular education programs to obtain degrees of the national education system, visiting lecturers must meet the standards stipulated in Clause 2, Article 70 of the Education Law 2019;
A visiting lecturer who is a permanent teacher or a regular teacher at a preschool or general education institution must achieve the professional standards for teachers of the education level in which the teacher is visiting.
- For teaching topics not included in preschool, general education, vocational secondary education, higher education, and regular education programs to obtain degrees from the national education system as specified in point b, Clause 1, Article 2 of the Regulations on policies for visiting lecturing in educational institutions issued together with Circular 44/2011/TT-BGDDT, visiting lecturers must have appropriate educational qualifications and professional experience.
- For teaching foreign language and information technology training programs at continuing education centers, visiting lecturers must have a professional qualification of at least a college degree.
- For the activities mentioned in point c, Clause 1, Article 2 of the Regulations on policies for visiting lecturing in educational institutions issued together with Circular 44/2011/TT-BGDDT, visiting lecturers must meet the standards stipulated in Clause 2, Article 70 of the Education Law 2019 and the regulations for master's and doctoral training programs.
- For the activities mentioned in point d, Clause 1, Article 2 of the Regulations on policies for visiting lecturing in educational institutions issued together with Circular 44/2011/TT-BGDDT, visiting lecturers must meet the laboratory, practice, and internship requirements of the subject, topic, and education program; and meet the standards required for laboratory staff.
- For the activities mentioned in point đ, Clause 1, Article 2 of the Regulations on policies for visiting lecturing in educational institutions issued together with Circular 44/2011/TT-BGDDT, visiting lecturers must ensure at least one of the following requirements depending on the discipline or major in which they are lecturing:
+ Have research papers published in scientific journals or in the proceedings of scientific conferences, domestically or internationally;
+ Have specialized books published;
+ Have scientific research projects approved and completed at the faculty level or higher;
+ Have a technology transfer agreement that has been approved and settled.
What type of contract is a visiting lecturing contract for a public employee being an educator in Vietnam?
According to Article 7 of the Regulations on policies for visiting lecturing in educational institutions issued together with Circular 44/2011/TT-BGDDT, the regulations on visiting lecturing contracts are as follows:
Visiting Lecturing Contracts
1. For visiting lecturers who are officials and public employees
a) Visiting lecturing contracts are work contracts. The conclusion, implementation, amendment, and termination of visiting lecturing contracts shall comply with the provisions in Section 7, Chapter XVII of the Civil Code. Employment contracts are not applicable for visiting lecturing activities of officials and public employees.
b) The visiting lecturing contract must include a clause in which the visiting lecturer commits to ensuring the completion of their duties at their current workplace.
- For visiting lecturers who are not officials and public employees**
a) For the activities mentioned in points a, b, c, d, Clause 1, Article 2 of this Regulation, the visiting lecturing contract is an employment contract as regulated by the Labor Code. The conclusion, implementation, termination of visiting lecturing contracts, complaints, denunciations, and resolution of complaints, and denunciations shall comply with the relevant labor law provisions.
b) For the visiting lecturing activities mentioned in point đ, Clause 1, Article 2 of this Regulation, the visiting lecturing contract is a work contract. The conclusion, implementation, amendment, and termination of visiting lecturing contracts shall comply with the provisions in Section 7, Chapter XVII of the Civil Code.
Thus, the visiting lecturing contract for a teacher who is a public employee is a work contract.
