What are duties and rights of Vietnamese lecturers travelling abroad for teaching?
According to Article 19 of Decree 86/2021/ND-CP, the rights and responsibilities of Vietnamese lecturers travelling abroad for teaching are as follows:
* Rights:
- Protected by the Vietnamese representative agency abroad with regards to their lawful rights and interests in accordance with Vietnamese law, the law of the host country, and international law and practices during their teaching period abroad.
- Allowed to remit salaries, wages, income, and other personal assets back to Vietnam in accordance with Vietnamese law and the law of the host country.
- If they are employees of an organization funded by the state budget, they are entitled to salaries, wages, other income, medical examination and treatment policies, social insurance, and other benefits based on an agreement with the direct managing agency and will be re-accepted by the agency upon completion of their work abroad.
* Responsibilities:
- Comply with the decision to be sent to teach abroad.
- Strictly adhere to Vietnamese law and the law of the host country; register as a Vietnamese citizen abroad according to current regulations.
- Pay social insurance, health insurance, personal income tax (if any), and other mandatory fees according to current state regulations; if international treaties that Vietnam has signed or joined provide for different personal income tax obligations than those currently stipulated by Vietnamese law on personal income tax, follow the international treaty.
- Protect state secrets as outlined in the Law on Protection of State Secrets 2018 and protect internal political information.
- Do not use teaching, professional activities, or any other means to propagate against the Vietnamese government or adversely affect diplomatic relations between Vietnam and the host country.
- Do not violate regulations on scientific and technological activities of Vietnam and the host country, or existing laws on the duties and responsibilities of teachers that affect Vietnam's image and reputation in the partner country.
- Work at the designated location; strictly adhere to workplace rules; return to Vietnam after the teaching program as required by the partner country.
- Do not exploit the teaching assignment abroad to work or stay illegally, except in cases where staying abroad is extended due to illness, war, natural disasters, or epidemics.
- Comply with agreements made with direct managing agencies and the competent agencies that send them to teach abroad (if any).
- Follow current regulations for officials and public employees and the regulations of the Communist Party (for officials, public employees, and party members).
- Submit reports to direct management agencies every three months.
What are the responsibilities of higher education institutions sending Vietnamese lecturers travelling abroad for teaching?
Based on Article 20 of Decree 86/2021/ND-CP, the rights and responsibilities of higher education institutions when sending Vietnamese lecturers travelling abroad for teaching are as follows:
- Rights:
+ Exercise foreign cooperation rights as stipulated in Article 44 of the Law on Higher Education 2012 and Article 71 of the Law on Science and Technology 2013.
+ Organize sourcing, selection, training, and assign individuals to teach abroad.
+ Require individuals assigned to teach abroad to adhere to institutional regulations or agreements between both parties before going abroad (if any).
+ Require individuals assigned to teach abroad to report their work results during their time abroad.
- Responsibilities:
+ Select individuals with the right political, ethical, professional competencies, and professional standards to be sent to teach abroad.
+ Monitor the progress of individuals assigned to teach abroad and re-employ them after they finish their teaching program abroad.
+ Report the assignment of individuals to teach abroad to competent agencies (if any) and in accordance with Article 28 of Decree 86/2021/ND-CP.
