According to the provisions of Article 9 Circular 49/2021/TT-BGDDT on the Regulation of organization and operation of independent nursery groups, independent preschool classes, independent preschool classes of semi-public and private types issued by the Minister of Education and Training, it states:
Conditions, procedures for establishment, merger, division, separation, suspension of educational activities, permission to resume educational activities, dissolution of independent preschool education institutions
To be implemented in accordance with the regulations of the Government of Vietnam on investment and operation conditions in the field of education.
According to Article 10 Decree 46/2017/ND-CP (amended by Clause 5, Article 1 Decree 135/2018/ND-CP), to establish an independent nursery group, the following conditions are needed:
[1] Having a teacher who meets the prescribed standards.
[2] Having a room for nurturing, caring, and educating children safely; ensuring the room's area is at least 1.5 m2 per child; having a playing area, safe fences, and gates; where meals are provided, there should be a separate, safe kitchen; ensuring fire and explosion prevention and food hygiene safety. Having enough clean water for daily use and drinking water for children.
[3] Equipment for an independent nursery group includes:
- Minimum equipment for children: mats or carpets for sitting and playing, beds, blankets, pillows, and mosquito nets for sleeping, drinking water containers, toys and playing facilities, racks for towels and cups, enough potty chairs, and materials for structured play and practice activities;
- Materials for caregivers include: a set of guidelines for implementing child care and education activities, a child tracking book, an asset tracking book for the nursery group, and educational materials for parents.
[4] Equipment for an independent preschool class:
- Minimum equipment for children includes: properly sized tables and chairs for children (especially for 5-year-olds); one table and two chairs for two children; one table, one chair, and one board for the teacher; toys and educational tools; drinking and daily use water containers; materials for structured play and learning activities.
For part-day classes: having mats or beds, blankets, pillows, mosquito nets, and fans.
- Materials for teachers include: a set of guidelines for implementing child care and education activities, a child tracking book, a book for recording the organization of children’s daily activities, and educational materials for parents.
[5] For areas where the network of preschool education institutions does not meet the demand for sending children to school, individuals can organize nursery groups to meet parents' needs for nurturing and caring for children and must register activities with the commune-level People's Committee, ensuring the following activity registration conditions:
- The maximum number of children in the nursery group is 07.
- The caregiver must be in good health, capable of civil responsibility, and have a certificate of professional training in child care and nurturing as prescribed.
- Facilities must meet the minimum conditions: the child care room must have a minimum area of 15 m2; ensuring safety, ventilation, and cooling; having safe, age-appropriate toys; having enough utensils and equipment for child care and nurturing; having sufficient drinking and daily use water for children; having a restroom and appropriate sanitation equipment for children; and having guidelines for implementing child care and education activities.

Based on Article 11 Decree 46/2017/ND-CP (amended by Clause 6, Article 1 Decree 135/2018/ND-CP), the procedure for establishing a nursery group or independent preschool class is as follows:
* Required documents:
[1] A proposal for permission to establish a nursery group or independent preschool class;
[2] Semi-public, private kindergartens, preschools, and nurseries can rent state-owned facilities, public education institutions’ facilities to organize educational activities according to the law;
[3] Copies from the originals, certified copies, or copies against the originals of diplomas, certificates of teachers, or caregivers.
* Implementation steps:
Step 1: Organizations or individuals submit one dossier directly or by post to the commune-level People’s Committee according to Clause 2, Article 11 Decree 46/2017/ND-CP;
Step 2: The commune-level People’s Committee receives and assesses the dossier. Within 5 working days from the date of receipt, if the dossier is unsatisfactory, it will notify in writing the contents to be amended or supplemented to the organization or individual; if the dossier is conformable, it will send a document to the Department of Education and Training requesting a practical inspection of the establishment conditions for the nursery group or independent preschool class;
Step 3: Within 10 working days, the Department of Education and Training organizes a practical inspection and sends its written opinion to the commune-level People’s Committee, clearly stating whether the nursery group or independent preschool class meets the establishment conditions;
Step 4: Within 5 working days from the date of receipt of the reply from the Department of Education and Training, the Chairman of the commune-level People’s Committee makes a decision to establish or permit the establishment; if not decided, a written notification will be sent to the organization or individual and to the Department of Education and Training, stating clearly the reasons.
* The Chairman of the commune-level People’s Committee decides to allow the establishment of the nursery group or independent preschool class.

According to the provisions of Article 11 Circular 49/2021/TT-BGDDT regulating the standards for the owner of an independent nursery group, independent preschool class, it states:
