Who is eligible for the teaching seniority allowance in Vietnam?
According to Article 2 of Decree 77/2021/ND-CP, individuals eligible for the teaching seniority allowance are educators currently teaching and educating in public educational institutions and academies, schools, centers with the mandate to train and retrain under state agencies, political organizations, and socio-political organizations (hereinafter collectively referred to as public educational institutions), including:
- Educators including public employees specialized in education and training (bearing codes starting with V.07) and public employees specialized in vocational education (bearing codes starting with V.09) under an approved payroll list, teaching and educating in public educational institutions funded by the State (including revenue from the state budget and other legal sources) (1).
- Educators under an approved payroll list, teaching, guiding practical, experimental sessions at training ships, school workshops, stations, camps, practice centers, laboratories, subject rooms of public primary education institutions, continuing education institutions, vocational education institutions, public higher education institutions (1).
Note: Individuals not covered under (1) and (2) but holding codes starting with V.07 and V.09 are not eligible for the teaching seniority allowance.

- The period of work calculated for seniority allowance, including: the period of work classified under one of the grades or titles in customs, courts, procuracy, audit, inspection, civil judgment execution, forest protection, national reserve, party inspectorate; the period of work calculated for seniority allowance in the military, police, ciphers, and periods eligible for seniority in other sectors (if any).
- The period of military service as stipulated by law if the period before serving military duty is calculated for professional seniority allowance.
Period Not Included in the Calculation of the Teaching Seniority Allowance
According to Clause 2, Article 3 of Decree 77/2021/ND-CP, the periods not included in the calculation of the seniority allowance include:
- Probationary period.
- Period of unpaid leave from work continuously for 01 month or more.
- Period of prolonged sick leave or maternity leave beyond the limit according to social insurance regulations.
- Period working as an expert, studying, interning, working, or surveying domestically and abroad beyond the deadline decided by the competent authority.
- Period of temporary suspension of work or detention for investigation, prosecution, or trial.
- Period not working apart from the periods specified in points a, b, c, d, đ of Clause 2, Article 3 of Decree 77/2021/ND-CP.
