Pursuant to Article 55 of the Education Law 2019 and Article 10 of the Charter of Primary Schools issued together with Circular 28/2020/TT-BGDDT, the regulations regarding the School Council of private primary schools in Vietnam are as follows:
- The School Council of a private school is a governance organization responsible for representing the investor and stakeholders, and is responsible for organizing the implementation of the investor's decisions.
- The composition of the School Council in private schools invested by domestic and foreign investors includes representatives of the investors, members inside and outside the school elected by the investor's meeting, and decisions based on the contribution ratio.
The composition of the School Council of non-profit private schools invested by domestic investors includes representatives of the investors elected by the investors based on the contribution ratio; members inside and outside the school.
Members inside the school include ex officio members such as the Secretary of the Party Committee, Chairman of the Trade Union, representatives of the Executive Committee of the Ho Chi Minh Communist Youth Union, the Principal; elected members representing teachers and employees elected by the school’s general meeting or representative meeting. Members outside the school include representatives of management leaders, educators, entrepreneurs, alumni elected by the school’s general meeting or representative meeting.

Develop strategies and plans for school development; plan and organize the implementation of teaching and education plans; report and evaluate the results before the School Council and authorized agencies.
Establish professional groups, office section, and councils for emulation and commendation; disciplinary council, advisory council within the school; appoint group leaders and deputies; assign teachers as Chief of the Ho Chi Minh Young Pioneer Organization.
Perform personnel management tasks for staff, teachers, and employees according to legal regulations and guidelines of educational management agencies; develop professional development plans for teachers and staff; encourage and facilitate teachers and staff to participate in educational innovation activities; conduct teacher and staff evaluation and classification according to the Ministry of Education and Training's regulations; participate in the recruitment, transfer, and arrangement of teachers; organize steps to introduce personnel for the appointment of vice principals by authorized agencies.
Manage and admit students, allow students to transfer schools; make decisions on student discipline and commendation; approve student evaluation results, lists of students promoted or retained; organize examinations to recognize students' completion of the primary education program within the school and other subjects in the school's jurisdiction.
Organize and implement the general education program for primary levels according to the Ministry of Education and Training's regulations; select textbooks and local educational content approved by the provincial People's Committee. Manage, use, and select reference publications for use within the school in accordance with the Ministry of Education and Training's regulations.
