What is the newest application form for registration of a household business providing extra classes in Vietnam?

Currently, the newest application form for registration of a household business providing extra classes in Vietnam is made in the form stipulated in Appendix III-1 issued together with Circular 02/2023/TT-BKHDT (replacing Appendix III-1 issued together with Circular 01/2021/TT-BKHDT) as follows:

What are the instructions for filling out the newest application form for registration of a household business providing extra classes in Vietnam?

Instructions for filling out the newest application form for registration of a household business providing extra classes in Vietnam are provided as per Appendix III-1 issued with Circular 02/2023/TT-BKHDT (replacing Appendix III-1 issued with Circular 01/2021/TT-BKHDT) as follows:

  1. Household businesses have the freedom to operate in business lines allowed by law:

    + Banned business lines are stipulated in Article 6 of the Investment Law 2020:

     Banned business lines

    1. The business investment operations below are banned:

    a) Business in narcotic substances specified in Appendix I hereof;

    b) Business in chemicals and minerals specified in Appendix II hereof;

    c) Business in specimens of wild flora and fauna specified in Appendix 1 of Convention on International Trade in Endangered Species of Wild Fauna and Flora; specimens of rare and/or endangered species of wild fauna and flora in Group I of Appendix III hereof;

    d) Prostitution business;

    dd) Human trafficking; trade in human tissues, corpses, human organs and human fetuses;

    e) Business operations pertaining to asexual human reproduction;

    g) Trade in firecrackers.

    h) Provision of debt collection services.

    2. The Government’s regulations shall apply to production and use of the products mentioned in Points a, b, and c Clause 1 of this Article during analysis, testing, scientific research, medical research, pharmaceutical production, criminal investigation, national defense and security protection.

    + For conditional business lines, household businesses may only engage in operations once they meet the required conditions. The list of conditional business lines is stated in Appendix IV issued together with Investment Law 2020 (supplemented by Clause 5, Article 3 of Law on Amendments to the Law on Public Investment, Law on Public-Private Partnership Investment, Law on Investment, Law on Housing, Law on Bidding, Law on Electricity, Law on Enterprises, Law on Special Consumption Tax and Law on Civil Judgment Enforcement 2022, Clause 1, Article 2 of Law on Amendments to the Law on Radio Frequency 2022, Article 155 of Insurance Business Law 2022, Clause 1, Article 63 of Archives Law 2024 and point c, Clause 11, Article 2 of Law on Amendments to the Planning Law, Investment Law, Law on Investment in the form of Public-Private Partnership, and Bidding Law 2024 effective from July 01, 2025).

  2. List the business line and Level 4 business line code in the Vietnam economic business line system for the primary business line. For other business lines, household businesses have the freedom to write (free text) and are not required to list Level 4 business line codes.

  3. In cases where a household business receives the Certificate of Household Business Registration after the declared starting date of operation, the starting date of operation will be the date the household business is granted the Certificate of Household Business Registration.

  4. Declare only in cases where the entity establishing the household business comprises family members and include the information of the household head in this Table.

  5. The head of the household business signs directly in this section.

What are the rules of extra classes in Vietnam?

Under Article 3 of Circular 29/2024/TT-BGDDT (effective from February 14, 2025), the rules of extra classes are as follows:

- Extra classes are only organized when students wish to attend extra classes and have consent from parents or guardians (hereinafter collectively referred to as parents). Schools, organizations, or individuals organizing extra classes are not allowed to force students into extra classes in any manner.

- The content of extra classes must not contravene the regulations of Vietnamese law, and must not bear biases regarding race, religion, occupation, gender, or social position. There shall be no omission of educational content according to the school's educational plan to include in extra class sessions.

- The purpose of extra classes must contribute to the development of students' qualities and abilities; it must not affect the organization of the school’s education program or the implementation of the subject curriculum by teachers.

- The duration, time, location, and form of organizing extra class sessions must be suitable to the psychological and physical condition of the age group, ensuring students' health; must comply with the legal regulations about working hours, overtime, and other relevant legal regulations concerning security, order, safety, environmental hygiene, and fire prevention in the area where extra classes are held.

Additionally, Article 4 of Circular 29/2024/TT-BGDDT provides cases where extra classes in Vietnam are not allowed:

- Extra classes for primary school students must not be organized, except in cases of training in arts, sports, and life skills.

- Teachers currently teaching at schools are not allowed to offer external extra classes with fees to their students according to the school's educational plan.

-Teachers from public schools are not allowed to participate in managing or operating external extra classes but may be involved in teaching extra classes.
