Pursuant to Article 2 of the 2010 Law on Public Employees:

Public Employees

Public employees are Vietnamese citizens recruited per job positions, working at public service providers, under working contract policies, and receiving salaries from the salary fund of public service providers as per legal regulations.

According to Article 9 of the 2010 Law on Public Employees (amended by Clause 1, Article 2 of the 2019 Law Amending the Law on Cadres, Civil Servants, and Public Employees):

Public Service Providers and Their Organizational Structure and Management Activities

1. A public service provider is an organization established by competent State authorities, political organizations, or socio-political organizations per legal regulations, having legal status and providing public services, and serving state management.

2. Public service providers comprise:

a) Public service providers granted full autonomy in performing tasks, financing, organizational structure, and personnel (hereinafter referred to as fully autonomous public service providers);

b) Public service providers not granted full autonomy in performing tasks, financing, organizational structure, and personnel (hereinafter referred to as non-fully autonomous public service providers).

3. The Government of Vietnam shall specify the criteria for classifying public service providers in each career field; the transition of public service providers to a business model, except those in the fields of health and education; and management policies for public service providers based on the principles of ensuring streamlined and effective service.

4. Based on specific conditions and management requirements for each type of public service provider in different fields, the Government of Vietnam shall stipulate the establishment, functional structure, tasks, and powers of Management Boards in public service providers, and the relationship between the Management Boards and heads of public service providers.

Contract teachers are recruited under labor contract policies. Therefore, contract teachers are not public employees as stipulated by law.

Thus, the relationship between the parties will be that of an employee and an employer. This labor relationship is governed by the 2019 Labor Code and not under the 2010 Law on Public Employees.

According to Clause 1, Article 3 of Decree 74/2024/ND-CP, the monthly minimum wage and hourly minimum wage for employees working for employers in different regions are as follows:

Thus, it can be determined that the minimum salary for contract teachers in Region 2 is at least 4,410,000 VND per month.

Note: Actual salaries may be higher depending on the agreement between the teacher and the school in the labor contract.
