What are the regulations on the management and use of tuition in Vietnam?
Based on Article 13 of Decree 81/2021/ND-CP, the management and use of tuition are regulated as follows:
- Public education institutions use tuition fees according to the regulations of the Government of Vietnam on the financial autonomy mechanism of public service providers and aggregate them into the annual financial reports of the education institutions following the law.
- Private and non-public education institutions use tuition fees on the principle of self-reliance in revenue and expenditure and take responsibility for financial management concerning their activities. They must organize accounting work, pay taxes, and fulfill other financial obligations as required by law.
- Education institutions manage tuition fee collections and expenditures according to accounting, auditing, tax policies, and publicly disclose financial information as required by law; comply with inspection and examination requests from financial and educational management agencies, and take responsibility before the law for the accuracy and truthfulness of the information and documents provided.
- Before enrollment or student selection, education institutions must announce and publicly disclose tuition fees, training costs for each academic year, education level for preschool education, general education, tuition fee increase schedules (if any) for each academic year, and estimate for the entire course for higher education.
What are the regulations on collecting tuition in Vietnam?
Based on Article 12 of Decree 81/2021/ND-CP, the regulations on collecting tuition are as follows:
- Tuition fees are collected monthly; if the learner consents, the school can collect tuition fees for the entire semester or academic year at once. For continuous education institutions, continuous training, and short-term training courses, tuition fees are collected based on the actual months taught.
For preschool and general education institutions, tuition fees are collected for a maximum of 9 months per year. For higher education and vocational education institutions, tuition fees are collected for a maximum of 10 months per year.
- In the event of natural disasters, epidemics, or force majeure events, tuition fees are collected based on the actual months of study (including the period of organizing online learning or make-up classes at the school); tuition fees are not collected during periods when teaching is not organized.
The collection of tuition fees ensures the principle based on the actual months of study and any necessary additional costs for organizing teaching but does not exceed the total tuition fees calculated for the maximum number of months of an academic year (maximum 9 months/year for preschool and general education institutions, and maximum 10 months/year for higher education and vocational education institutions) and is publicly disclosed at the beginning of the academic year in educational institutions.
The Provincial People's Committee submits to the Provincial People's Council for decision on specific collection periods and tuition fees for public preschool and general education on the locality; heads of higher education institutions and vocational education institutions regulate collection periods and tuition fees in case of natural disasters, epidemics, and force majeure events.
- In case of organizing teaching and learning based on credits, education institutions may convert to collect tuition fees per credit; however, the total tuition fees collected per credit for the entire course must not exceed the tuition fees regulated for the course if collected per academic year.
- Education institutions are responsible for organizing the collection of tuition fees and depositing tuition fees into commercial banks or the State Treasury for management and use.
In case of tuition fee collections in cash, the unit must periodically complete procedures to transfer (deposit) all cash tuition fees remaining in the fund to the unit's account at the State Treasury or commercial banks for management according to regulations.
Who is exempt from paying tuition in Vietnam?
According to Article 14 of Decree 81/2021/ND-CP, the subjects exempt from paying tuition fees include:
- Public primary school students.
