What is the financial assistance for preschool children of workers in Vietnam?​

Clause 2, Article 8 of Decree 105/2020/ND-CP stipulates the financial assistance for preschool children of workers and employees working in industrial zones as follows:

Financial assistance for preschool children of workers and employees working in industrial zones

1. Eligible children

Children enrolled in private or people-founded nursery schools that have been licensed and operate in compliance, with at least one parent or guardian working as a worker or employee in industrial zones under an employment contract.

2. Policy details

Eligible children as defined in Clause 1 of this Article are entitled to a minimum support of 160,000 VND per child per month. The support period is calculated based on actual school months but must not exceed 9 months per school year.

The support amount is determined by the provincial People’s Committee in accordance with the local budget capacity, to be submitted to the Provincial People’s Council for consideration and decision.

Thus, according to the above legal provisions, the minimum support for nursery children of workers in industrial zones is 160,000 VND per child per month.

Additionally, the support period will be calculated based on the actual school months but must not exceed 9 months per school year.

What are procedures for workers in industrial zones with children in nursery schools in Vietnam to receive support?

Based on Clauses 3 and 4, Article 8 of Decree 105/2020/ND-CP:

* Regarding the application

- Application for support for nursery children of workers and employees in industrial zones (Form 03 specified in the Appendix attached to this Decree) with confirmation from the employer of the parent or guardian working there;

- Birth certificate or household registration book or temporary residence certificate of the child (copies accompanied by the originals for comparison or certified copies).

* Regarding the process, timeline, and implementation method

- Process and timeline

Every August, nursery schools will widely announce and guide parents or guardians of eligible children to submit applications for support;

Within 15 working days from the date the nursery school announces, parents or guardians submit directly or via mail or online one set of application as specified in Clause 3, Article 8 of Decree 105/2020/ND-CP to the nursery school.

The nursery school will receive and check the application components, and if the submitted components are copies without the competent authority's certification, the receiver will compare them with the originals, confirm the copies for the file, and request supplementation if the file is incomplete or unsatisfactory.

After receiving a complete application, the nursery school will issue a receipt to the parent or guardian. If the application sent by mail or online does not meet the requirements, within 5 working days the nursery school will send a notification of non-acceptance and the reasons to the parent or guardian.

Within 10 working days from the deadline for receiving applications, the nursery school compiles a list of eligible nursery children with the application specified in Clause 3, Article 8 of Decree 105/2020/ND-CP and submits it to the district’s Department of Education and Training for review and summary. The legal representative of the private or semi-private nursery school is fully responsible for the list of children eligible for support.

Within 7 working days from receiving the nursery school’s application, the district Department of Education and Training organizes verification, summarizes the list of eligible nursery children, sends it to the financial department for submission to the District People’s Committee for approval according to the State Budget Law.

Within 7 working days from receiving the application from the Department of Education and Training, the District People’s Committee approves the list of eligible nursery children and notifies the nursery school.

After approval by the competent authority, the nursery school publicly announces the list of supported nursery children.

- Implementation method

The nursery school is responsible for receiving the funds and directly paying the support by cash to the parents or guardians;

Support is paid twice in the school year: the first payment covers 4 months in November or December; the second covers the remaining months in March or April.

If the parents or guardians do not receive the support funds within the given period, they will be paid in the next payment cycle.

In case the child drops out, the nursery school must report it to the Department of Education and Training, and the department will submit it to the District People’s Committee to stop the payment policy.
